I know that Lee was not wanting to commit to a date, but I can’t think of another way to meet the Council and Mayor’s direction without a “no later than…” condition. I appreciate the City working with us on this condition. The modification will still meet the objective of the Council on the installation of the path. Who knows what the future holds, we may be doing 15 lot phases for a while if things don’t improve. My comment is as follows: 1. Page 13- Development Agreement Provision 5.1m reads: “The multi-use pathway and associated open space in Lot 27C, Block 3 shall be constructed prior to issuance of the first Certificate of Occupancy in Phase 3.” Considering the significant economic impact of the current national health crisis, I would recommend the th Council include language referring to the 117 lot. During the last economic crisis of the Great Recession, we were forced to reduce the number of lots within the phases and increase the number of phases. I had multiple projects in other jurisdictions that had phases as triggers for improvements and it caused significant problems. There are 84 lots within Phase 3 and if we reduce the number of lots and double the number of phases, the appropriate trigger should be the lot count. I respectfully request the Council require installation of the multi-use pathway and landscaping within the Williams Pipeline lot prior to the certificate of th occupancy of the 117 lot. This would be the first lot within what is shown as Phase 3 in the preliminary plat. This would accomplish the original intent of the Council’s condition.
