BY THE CITY COUNCIL: BERNT, BORTON, CAVENER,
HOAGLUN, PERREAULT, STRADER
A RESOLUTION OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
MERIDIAN, IDAHO, SETTING FORTH CERTAIN FINDINGS AND PURPOSES TO
APPROVE RETIRING MERIDIAN POLICE DEPARTMENT POLICE CANINES
"RANDY" AND "DORY"; AND TO DECLARE SUBJECT CANINES SURPLUS
PROPERTY OF NOMINAL VALUE; AND TO AUTHORIZE THE MAYOR OF THE
CITY OF MERIDIAN TO DONATE SUCH PROPERTY BY TRANSFERING
OWNERSHIP OF SUBJECT CANINE "RANDY" TO HIS HANDLER MERIDIAN
POLICE DEPARTMENT K-9 OFFICER RICK LEE; AND TRANSFERRING
OWNERSHIP OF SUBJECT CANINE "DORY" TO HER HANDLER OFFICER DAVE
CUSHING; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Mayor and City Council have received the recommendation from the
Meridian Police Department that police canines "Randy" and "Dory" are suitable for retirement
due to poor health and performance-related issues that no longer allow for each canine's proper and
safe use; and
WHEREAS, a retired police canine has no saleable value, as it would be unsafe or
inappropriate for possession by the general public; and
WHEREAS, the City wishes to divest itself of both ownership and vicarious or direct
liability for the subject canines; and
WHEREAS, it is in the best interest of the City of Meridian to thus declare that police
canines "Randy" and "Dory" as described in the attached Exhibit A are surplus property, with
nominal value, no longer needed or to be used by the City of Meridian; and
WHEREAS, due to the unique nature of police canine service dogs, the City's purchasing
policy for disposal of surplus property of nominal value, authorizes City Council to approve the
removal of a police canine from active duty, and authorizes transfer of ownership to a qualified
handler upon the recommendation of the Chief of Police; and
WHEREAS, it is the policy of the Meridian Police Department to recommend and support
the transfer of ownership of a retiring police canine to its handler or other experienced K-9 Officer
so that the canine who has served as a valuable member of the Department may remain and live out
the remainder of its days in suitable surroundings and appropriate companionship; and
WHEREAS,Meridian Police Department K-9 Officers Rick Lee("Officer Lee") and Dave
Cushing ("Officer Cushing") are currently "Randy's" and "Dory's" handlers respectively, and
Officer Lee is willing to accept responsibility for the care of"Randy"and agrees to assume financial
responsibility of, and liability for, the dog and to provide a comfortable, humane and caring
environment for the remainder of his life as does Officer Cushing on behalf of"Dory"; and

WHEREAS, Officer Lee agrees to accept ownership of "Randy" and Officer Cushing
agrees to accept ownership of "Dory", as each subject canine's present health condition exists
without warranty or representation from the City of what that condition is or may become; and
WHEREAS, Officer Lee and Officer Cushing each agree that the subject canine of which
each officer is accepting ownership will not perform any searches or activity related to patrol
narcotic-related duties or patrol apprehension-related duties; and
WHEREAS, Officer Lee and Officer Cushing each agree to release the City from any and
all liability that might arise from owning a retired police canine upon transfer of ownership; and
WHEREAS, the Mayor and City Council find that transferring "Randy's" ownership to
Officer Lee and "Dory's" ownership to Officer Cushing is the safe, appropriate, and humane
method for disposition of"Randy" and "Dory"upon each canine's retirement.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN CITY, IDAHO:
Section 1. That the Mayor and City Council approve the retirement of Meridian Police
Department police canines "Randy" and"Dory".
Section 2. That the Mayor and City Council declare the subject canines to be surplus
property of nominal value belonging to the City of Meridian.
Section 3. That the City Council authorizes the Mayor to donate by transferring ownership
of subject canine "Randy"to Meridian Police Department K-9 Officer Lee.
Section 4. That the City Council authorizes the Mayor to donate by transferring ownership
of subject canine "Dory"to Meridian Police Department K-9 Officer Cushing.
Section 5.That this resolution shall be in full force and effect immediately upon its adoption
and approval.
