bear Meridian City Clerk, we are writing regarding the application for a day care
at 5343 N. Maplestone Ave. We own the property at 5277 N. Maplestone Ave, the
3rd house south of proposed day care home. The delivery of your postcard on
3/11/2020 was our first introduction of this proposed day care.
The proposed application is not compatible for this residential zoning.
1. This subdivision, Jump Creek, has small lots, small driveways. There is no
designated parking area for six cars. The driveway at this property has continually
had 3 cars in the driveway. The typical parking spot,9'x 18',with 6 arriving cars,
would definitely have a negative impact on the street parking There is no
turnaround at this portion of the subdivision. Cars would have to drive around a
large block to leave.
2. Emergency service would have limited access to the front door for their
services. Pedestrian access to the front door is the small driveway blocked by 3
parked cars.
3. Front door has a residential fire code standard of 1 hour burn not 2 hours as a
standard for schools.
4. Jump Creek has an HOA and CC & R's which we have to abide by. We all signed
in escrow that we would uphold the HOA and CC & R's. The day care applicant has
not advised nor gotten approval f rom the HOA. The HOA was contacted by us on
3/11/2020 as to the status of this home occupation use. The HOA had no
knowledge of this proposed use. The homeowner of 5343 N.Maplestone was mailed
a letter notifying them that they needed approval, a form filled out, etc. As of
this morning, 3/24 the homeowner at 5343 N. Maplestone has not replied to MGM
Property Management.
5. The day care applicant has a 10' basketball backboard and hoop, portable, in the
driveway blocked by the 3 cars. We don't believe this is compliant with your code
standards. Will any of these 6 children be playing basketball in the street, which
is already heavily trafficked by construction vehicles?
In conclusion, this applicant has not held to the standard of getting neighbors
approval in writing per your application, nor have they bothered to hold to the
standard of our CC & Rs. We are concerned about what else they may overlook.
