Dear Meridian Community Development and City Council :
Please find attached an application to Vacate Plat Note # 7 on the Mystery View Subdivision Final Plat ( Book 84 Pg . 9301 )
which reads : "Only a single story building may be built on Lot 2, Block 1 " . Below, you will find the background of that
plat note as well as the reasons it makes sense to vacate it in exchange for moving the building even further away from
the Residential neighbors to the North . The address of the property in question is 2960 E . St Lukes Street, Meridian , ID .
Plat Note Background and History
Sometime prior to 2001 , a developer proposed the construction of a 4 to 5 - story AmeriTel Hotel on this property—directly
adjacent to R - 1 & R - 2 Residential lots . The neighbors avidly protested and it was struck down .
A year or so later , WH Moore Company submitted a new plat map showing smaller lots with more compatible uses which
was approved in 2002 . Based on the history with the neighbors however , there were two concessions included which
the owner recalls were " a hat tip by the City Council to the adjoining neighbors " .
The first concession was that a 4 ' high berm would be installed along the North property line ( above an ACHD drainage
pipe) with a 6 ' high fence on top . This created a visual barrier between the commercial lot and the residential neighbors
to the North .
The second was that Lot 2 would be restricted to " a single story building"—which , ironically, was the ONLY restriction
of its kind in the new Plat Map .
Contradicting Restrictions
Although the Plat Note restricting Lot 2 to a single story building was recorded , the effort to restrict the overall height of
the building was not effective because—per the L - O zoning—the building can still be built at 35 ' high ( with 0 ' setbacks
in some areas ) . This created a contradiction which may have been overlooked because wecan build a VERY large , 35 '
high building on the property— it just can ' t have a 2nd story inside of it . Which doesn ' t make a lot of sense .
Current Situation
Arete Investments Group , LLC purchased this lot from WH Moore Company in January of 2020 ( 18 years after the previous
plat recording) .
Arete is working with some local surgeons to construct an Ambulatory Surgical Center in one half of the building and
Medical Office Suites for those same surgeons on the other half of the building . As currently drawn up , this will be a
15 , 800 sqft Medical facility which is a GREAT match for compatibility between the current medical /commercial in the
area ( less than 1/4 mile from St . Lukes Meridian ) and the residential neighborhoods to the North .

Coordination with Neigbo
The first step I took was to go and meet personally with EVERY adjoining residential neighbor . I shared with them the
concept of what we are planning to build and laid out the reasoning for why it might make more sense to all parties if we
could build it as a two - story building with a smaller footprint . Specifically, I made the point that the building would NOT
- • to be any taller if it is a two ory - . • . • some areas with 22 ' high single - storyBut, if we were
able to layer the floors , • • reduce nearly illl sqft of building footprinton • t, which would move the building

( of the same height) nearly 80 ' further away from their homes . This would also allow for approximately 20 - 25 MORE
parking spaces , which will alleviate parking constraints with the commercial neighbors .
In every instance , the neighbors have agreed that the two - story option makes MORE sense than building a larger building
(with 10 ' parapet walls , simply to add false height to the elevation ) right up against their fence lines .
By the end of this week, I will add a " Statement on Non - Opposition " to this Plat Note Vacation application (which will
be signed by EVERY residential neighbor within 300 ' of the property) showing they do not oppose removing the single -
story restriction if the building moves further away from the Northern property line . I will also work with the Commercial
neighbors to make sure they don ' t mind as well .
Conclusion
By approving this Vacation of Plat Note 7 and removing the " Single Story Building " restriction :
• The maximum height of the building remains the same ( at a maximum of 35 feet)
• Arete would agree to an 80 ' minimum setback from the Northerly property line ( away from Residential neighbors )
• We gain 20 -25 more parking spots in the development ( helping the parking issues with Commercial neighbors )
I hope you will consider this option—to which all contiguous neighbors have agreed—as it really is a better situation for
all involved .
