Attached for your review and favorable consideration is an application for Alternative Compliance for the Delano
Residential Community located near Ustick and Eagle Roads. Due to the Fact that the Multi -Family Project (Brickyard)
that has just been constructed south of this property has 3 -story apartment buildings that are only 15 feet from the
property line we have been forced to construct a 29' wide landscape buffer. This buffer area is intended to create a
separation between the dense 3 story multi -family buildings and our proposed single-family houses. As you can see
from the photos below, the three-story buildings in the Brickyard Apartments are an ominous sight and not compatible
with single family residential backyards.
Unfortunate, City Code does not recognize our 24,263 SF buffer as Qualified Open Space. We are requesting alternative
compliance to allow for this large (over %2 acre) area be counted toward the 10% open space requirement in the Delano
Neighborhood.

As you can see in the landscape plan above and the qualified open space map below we have designed the Delano
Neighborhood with a buffer and full street section between the two uses.

We respectfully request that the City approve our application for alternative compliance and allow the inclusion of our
