Public Works CDBG Grant - Streetlights Second Amendment to FY18SUBRECIPIENT AGREEMENT BETWEEN CITY OF MERIDIAN, COMMUNITY DEVELOPMENT DEPARTMENT AND CITY OF MERIDIAN, PUBLIC WORKS DEPARTMENT FOR PROGRAM YEAR 2018 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS SECOND AMENDMENT This Subrecipient Agreement is entered into this 7th day of January , 2019 by and between the City of Meridian, a municipal corporation organized under the laws of the state of Idaho ("City"), by and through the Community Development Department (CDBG Program Coordinator), and MERIDIAN PUBLIC WORKS DEPARTMENT ("Subrecipient"). WHEREAS, on January 8, 2019, City and Subrecipient entered into Program Year 2018 Subrecipient Agreement ("PY18 SRA"), a cooperative agreement for the investment of Community Development Block Grant ("CDBG") funds; and WHEREAS, Subrecipient requires additional time to complete the activities in the PY18 SRA; NOW, THEREFORE, in consideration of the mutual covenants of the parties, the Parties agree as follows: I. PROVISION MODIFIED — SCOPE OF SERVICE. Section I.A. shall be amended as follows: A. Activities. Subrecipient shall use City's PY18 CDBG funds in an amount not to exceed sixty —one thousand one hundred seventy-eight dollars ($61,178). Activities shall be broken into two (2) phases over the term of this Agreement. Completion of Phase 1 must be agreed upon by both the Community Development Program Coordinator and the Subrecipient prior to moving into Phase 2. 1. Phase 1. The Subrecipient will be responsible for designing and installing streetlights in the area of E. Chateau Drive, N. Jericho Road, N. Amethyst Avenue, E. Torrington Court, E. Willowbrook Drive, and N.E. 10th Avenue corridors in the area near Chief Joseph Elementary School, in a manner satisfactory to the City and consistent with any standards required as a condition of providing the funds. This project is eligible under 03K (Street Improvements). 2. Phase 2. The Subrecipient will be responsible for designing and upgrading streetlights in the Gem Park No. 1 and No. 2, Strate, Mirage Meadows, Wesley and Meridian Place No. 3 Subdivisions in the area near Chief Joseph Elementary School. Prior to construction, the Public Works Department will submit a report to Community Development Department for any upgrades to ensure they are necessary and not part of the City's normal maintenance. Community Development will submit to HUD for approval. Activities during both phases must be completed in a manner satisfactory to the City and consistent with any standards required as a condition of providing the funds. This project is eligible under 03K (Street Improvements). II. PROVISION MODIFIED — TIME OF PERFORMANCE. Section I.E. shall be amended as follows: SECOND AMENDMENT TO PY18 SUBRECIPIENT AGREEMENT - CITY OF MERIDIAN, PUBLIC WORKS DEPARTMENT PAGE 1 OF 2 E. Time of performance. Services of Subrecipient shall start no earlier than October 1, 2018 and end on or before June 30, 2020 Deeembei: 31 2019. The term of this Agreement and the provisions herein shall be extended to cover any additional time period during which Subrecipient remains in control of CDBG funds or other CDBG assets, including program income. III. PROVISION MODIFIED — DRAW REQUESTS. Section II.J.3 shall be amended as follows: 4. Draw Requests. It is expressly agreed and understood that the total amount to be paid by City under this Agreement shall not to exceed sixty one thousand one hundred seventy-eight dollars ($61,178). City will not accept or process draw requests prior to City's reception of Congressional Release of Funds; the CDBG Administrator shall notify Subrecipient of such release and the opportunity to submit draw requests. Draw requests for the payment of eligible expenses shall be made against the activity specified, in accordance with performance, and as expenses are incurred by Subrecipient. Draw requests shall only be accepted on official City and/or HUD forms and must be completed in full to be processed. All draw requests are to be submitted as needed in coordination with the CDBG Administrator. Draw requests shall include the following: draw request form, progress report, transaction detail completed for the relevant draw request period, and proof of payment by Subrecipient (such as copy of check and bank transaction information showing payment of check, copy of receipt of payment by contractor or subcontractor, and/or other relevant documentation of payment). Subrecipient's final draw request under this Agreement must be submitted by Subrecipient no later than July 15, 20201^^"^"<. i 2mn. WHEREAS, all provisions of the PY18 SRA shall remain in full force and effect except as expressly modified by this Second Amendment or other duly executed addenda. No other understanding, whether oral or written, shall be deemed to enlarge, limit or otherwise affect the operation of the PY18 SRA or this Second Amendment thereto.
