WATER MAIN EASEMENT AGREEMENT
TillS INDENTURE made this z# day of ~ ' 2006, between the
County of Ada, a political subdivision of the State of Idaho, ereinafter desIgnated as the Grantor,
and the City of Meridian, hereinafter designated the Grantee;
WITNESSETH
That the Grantor in consideration of the sum of one dollar ($1.00) and other valuable
consideration does hereby grant and convey unto the Grantee, its successors and assigns a
conditional easement and right of way, sufficient in width to install und maintain a water main
including the right to enter upon the real estate hereinafter described, at all reasonable times, to
construct, maintain, and repair over, through, under, and across said lands, together with the right,
at the sole expense of Grantt:t:, to excavate and refill ditches and trenches for the location of said
water main, over, and across the following described real property belonging to the said Grantor:
See Exhibit A and B, attached hereto.
Grantor grants said easement for all of the above-described real property to Grantee and its
successors and assigns tor so long as Grantee shall use the aforesaid property for the purposes
mentioned above. If Grantee fails to so use the property for such purposes for a continuous period
of one (1) year or more, the above-described real property shall automatically revert to Grantor and
its successors and assigns without it being necessary for Grantor and its successors or assigns to
take any affirmative action to effectuate the reverter.
The Grantee covenants with the Grantor, its successors and assigns, that the Grantee will
restore the surface of the ground in as good of condition as when entered upon by the Grantee and
its agents. The Grantee further covenants with the Grantor that it will restore the surface of the
ground as when entered upon by the Grantee and its agents, after any repairing or maintaining of
said.
This conditional easement extinguishes and replaces any previous existing easements on
the above-described property.
