I have been out of the office for several days and I apologize for the delay in getting back to you. The
streetlights will not have to be installed with this building permit due to the frontage issues. Please
be advised that in the future if lot lines change any new development that does have frontage will be
required to install streetlights.

Hi, Al,
I have more of the story. It seems as though the lighting plan you provided via email yesterday was
recently completed in response to the City’s conditions of approval. We believe that the architect
(Jay) saw the requirement and added the lights in, however, he added them without letting the
developer/owner know which is why the owner’s surprise is surfacing now. I thought this
background was helpful for all of us to know as we discuss this further.
So, yes, you are correct in that the developer is saying that he doesn’t want to install the streetlights;
it should help to note that his manner is more that he feels it is an unfair requirement, not that he
“doesn’t want to”. I’ll break down his rationale for you:
1. Firstly, streetlight requirements are not included in his Development Agreement with the
City;
2. Secondly, he has zero street frontage on this property/development - it seems to me that
only those that are developing along the frontage would be required to install the ROW
improvements (he doesn’t even have frontage on Beethoven Ave. – his improvement pad is
completely set back from any roadway);
3. Thirdly, at the time that he originally developed the site, he did so working around the ACHD
project that fronts the area in question – it seems that ACHD would have been the one to
add the street lights?;
4. Lastly, he feels the expectation of him having to tear up existing improvements and being
responsible for replacing them (again, not a part of his development/improvement area) is
unreasonable.
I have to say I share in his feelings. What are your thoughts regarding the situation? Do you think
we can avoid making him responsible for improvements that are far beyond his development pad?

Peggy,
Thanks for the email. I am a little confused on this one. I have an approved streetlight plan for this
development (see attached). Are you telling me they don’t want to install the streetlights now? The
standards are updated regularly. One of the main focuses of the updates is to get streetlights
installed in deficient areas, especially along arterial roads.

I’m cc’ing Al Christy (Transportation and Utility Coordinator with Public Works) here because
he’ll be able to address your question regarding the street light requirements better than I can. Al,
what is our policy on this?
Regarding the landscape island referenced in Note #5, we can allow for alternatives to code
requirements through Alternative Compliance. If there’s a utility pipe there, you could place the
required tree elsewhere or could propose extra bushes/shrubs and ground cover in lieu – I think
either would suffice. If this is the route you’d like to go, you’ll need to submit an alternative
compliance application (fee of $160) that I can add to the CZC and DES approval. It is an
administratively reviewed application so shouldn’t take too long to review and approve.

Hi, Stephanie,
I am back! And I have LOTS of pictures. J
I just had the team reach out to me about something that they were surprised with, and were
hoping the City would be willing to reconsider on the CZC, given the conditions of the site.
What I’m referring to is the requirement for a street light in front of the development for
Woodland Springs (see below, top snipit image). The developer said that last time they were
ready to develop, the CZC did not require it; but in my due diligence it looks like this
requirement was in the 2016 Standards Manual. So it makes sense to me that the developer
wasn’t expecting it, and Cities update requirements all the time. I really do see both sides.
What I think is fair to ask the City to consider are 2 points: the fact that our building doesn’t
have any frontage along McMillan - the building only fronts a common lot owned by
Maverick, which has a cross access easement; the second consideration is the distance our
building is from the right of way (approx. 200-feet shown below in 2nd
pic). The builder is
really struggling with the idea that he would have requirements in the right-of-way with zero
frontage of his property.
Is there anything that we can do to avoid this? Perhaps submit a variance? Or some other
option? Honestly, I would push back on them if I thought they were asking for us to request
something out of convenience, or cost, etc (I’ve done it a few times), but in this case I think
there may be room for concession. I’d be happy to discuss.
Also, the engineer asked me to ask a question on the landscaping notes. One of the notes (#5) (see
3rd
snipit image) asks for a tree in the NW corner island…but there is a 48” utility pipe there. Eek.
What other option would we have to landscape there? Should we take one of the bush groupings
out and put a tree in place? See the “X” in the last pic below.

I truly appreciate any consideration your team and the City would offer. Like I said, I hate when
developers as us to get them out of things, but in this case I felt he had a very fair point.
