Action Items Public Hearings for Land Use Applications follow this process: Once the Public Hearing is opened, City staff will present their report. Following the report, the applicant is allowed up to 15 minutes to present their application. Members of the public are allowed up to 3 minutes each to address council regarding the application. If a person is representing a large group such as a Homeowner's Association, indicated by a show of hands, they may be allowed up to 10 minutes. Following all public testimony, the applicant is then allowed 10 additional minutes to respond to comments. Once the public hearing is closed, no additional testimony will be received. The City Council may move to continue the item for additional information or vote to approve or deny the item with or without changes as presented. If you will, please, tell us your name and address. Pitzer: Yes. I'm Patty Pitzer. 2703 East Wainwright Drive in Meridian. 83646. De Weerd: Thank you, Patty. Pitzer: And I just -- Honorable Mayor, Councilmen, I am just here today trying to find out what the process is for a future development. I see new subdivisions going in all the time. Over the past year I have spent time over at the Planning and Zoning Commission. I have been here in your Council meetings, sitting in back, trying not to make too much noise, and I have seen many developers, builders, go through the planning and zoning process and it's not a cut and dried process. I mean they really go through a lot, going through the ambience, the -- the traffic patterns, all kinds of things and I applaud them for taking on the task. It's -- it's phenomenal. I have even seen builders come in three, four, five times trying to get the plan in place before it comes before you -- before the Council. But I have started to see a change, a shift, where some of the developers are bypassing the planning and zoning process and coming straight to Council and I -- I understand that the Planning and Zoning Commission is like an input with -- and -- but, you know, I -- and it's their right to come to the Council, but in some cases -- I mean I'm not sure how it works. Does -- once it comes before the Council is it just -- it's okayed or denied or can you guys push it back to Planning and Zoning, because they denied it there? De Weerd: Patty, maybe we will have Mr. Nary kind of give an overview and -- and if we need to can talk offline. Nary: Sure. Thank you, Madam Mayor. Madam Mayor, Members of the Council, so no development application comes directly to the City Council unless it's a modification of the development agreement. So, the -- the only ones that come directly to the Council that do not go to Planning and Zoning first are things that modify a development agreement, because that is a contractual agreement between the city and the property owner. So, those only come directly here. Everything else goes through Planning and Zoning and the development process. Annexation, conditional uses, all the other types of land use applications go to Planning and Zoning. The only other one that you might see is a final plat. So, occasionally, on the agenda there are final plats when the developer is bringing in the final configuration of their property and getting approval to move forward, so that they can begin the -- begin the building process. So, that doesn't go through Planning and Zoning, that comes here. So, those are the only two types that come directly here and they can't go back to Planning and Zoning. So, they do have to be heard by the Meridian City Council Meeting Agenda November 19, 2019 – Page 37 of 301 Meridian City Council November 6, 2019 Page 5 of 14 Council directly. So, everything else comes through P&Z. The Council can agree or disagree with what Planning and Zoning did or recommended. They can remand it back if the Council directs to do that. It just depends on the application. Everyone's unique. So, that's the general answer to your question. That's what comes here directly. Everything else goes to P&Z first. Pitzer: Okay. So -- so, when they are denied at -- at Planning and Zoning and the person says I guess we find out tonight and, then, obviously, I will be in front of City Council and those meetings will be a little bit easier to discuss, because, hopefully, Madame Mayor will be sitting there. So, you are denied at Planning and Zoning, so, then, it comes here? Nary: Yes. So, Planning and Zoning is not the final decision maker on land use applications. They are a recommending body. So, they recommend to the City Council whether or not they should approve it or not. Sometimes their recommendation for denial is based upon certain conditions of the application, things that they should change or rearrange or make some change before going to the City Council. That's the reason they denied it. So, yes, they all have to come to here. The only final decision the Planning and Zoning Commission can make is on what's called conditional use permits, which are very limited type of permission, and those can be appealed to the City Council if they are denied and so -- so, yes, even though Planning and Zoning may have recommended denial, it is merely a recommendation. It still has to come to the City Council for final decision. Pitzer: Okay. All right. Yeah. Because the one that we went through, they said there is so many flaws, but the fatal flaw needs to be corrected first and, then, he says, well -- never mind. Nary: They say lots of things that may -- they may believe or not, but that's -- that's the process of how it works. Pitzer: That's the process. Okay. I appreciate your time. Thank you very much. I just -- I just want to say I really appreciate your interest and your enthusiasm for land use. It's not -- there is not a whole lot of people out there who are just knocking on our door wanting to understand and really learn it. So, good for you and there is probably going to be an opening on the Planning and Zoning Commission coming up pretty soon if that's kind of the way you are looking. That's -- that's like a crash course. You learn it real fast. It's good though. Well, good for you. Item 7: Action Items A. [Amended on to Agenda] MYAC Update De Weerd: Thanks for being here. Okay. Under seven we will start with our Mayor's Youth Advisory Council update. They have been busy. Coursey: Hello. Thank you, Madam Mayor and City Council. I'm Jaelahna Coursey, I'm the chair of MYAC, standing in for Abby Hutchins, our vice-chair, and we just want to update you on some of the things that we have done and some of the things coming up. So, one of the first things that we did was the trunk or treating event. This we have often collaborated with all of the city and anybody who really signs up to put a trunk out. We had about 15 pieces of -- 15,000 pieces of candy handed out from our booth alone, which was for lost children and information booth and, then, we had all our MYAC'ers in their costumes helping out with the kids and with the event and that was a great success, as for most of the years that we have done that and is a great legacy project that we have been able to continue. One of our second events that has happened and been successful is our candidate forum that we held on October 21st. We had all five mayoral candidates come and it was one of the only times that they were able to be together -- or one of the minimal times that they were all able to be together and we had a very informal count of 150 people who showed up in person and it also got live streamed on idahonews.com where a lot of students I personally know tuned in for that in regards to their government class and we had -- I believe it's 12 out of the 14 candidates actually speak, show up and have a little booth in the lobby during the waiting periods and that was put on by MYAC as the timers, as the question vetters, and our government affairs chair and vice chair actually planned out the details with Mayor Tammy on that. So, it was all student led in that regard. And, then, our upcoming events. We are very excited about Rake Up Meridian this Saturday. So, as normal we are going to be raking up lawns of those who either physically can't or don't have the time and, then, we will also be afterwards having a teen activities event. All youth are invited and we are watching a movie at Majestic. We voted last meeting and decided that we will be watching Maleficent and so that will be what's occurring on Saturday. And, then, we are in the process of planning in the Teen Activities Committee, as well as in the Executive Council meetings our December holiday party. We have renamed it and rebranded it, because we had some members who culturally do not celebrate Christmas, so we are really excited about that change. It will be holiday and winter themed and we will also be inviting all of our alum to come join us Meridian City Council Meeting Agenda November 19, 2019 – Page 39 of 301 Meridian City Council November 6, 2019 Page 7 of 14 once again. And with that that's all that's been coming up and what's happened. Are there any questions. De Weerd: Thank you, Jaelahna. Any questions for Jaelahna? Cavener: Madam Mayor? De Weerd: Mr. Cavener. Cavener: A couple questions and comment. First, Jaelahna, thanks for the update. I got to watch the candidate forum via livestream and it was cool to see the collaboration with KTVB and watch it on Facebook and we got to find a bigger facility for the next livestream. I mean great job on that. Coursey: Thank you. Cavener: I'm curious about trunk or treat. That event seems to grow every year. I'm curious if you have a snapshot as to how many people came through, how many spots you had, I'm just -- I wasn't able to attend and I just -- I know it gets bigger and bigger. I'm just curious if you have an amount. Coursey: Yeah, it definitely does grow. I know at least personally my first year of MYAC it was in the parking lot and so now we cut off all those cross streets. I know last year we tried to have a count, but as it keeps growing it gets increasingly difficult. So, our only real way of measuring that this time was through the candy that we passed out and, again, that's only our booth. So, it's really hard to say, but we definitely had a lot of participation. The booth signups have been way in advance and Renee in Parks and Rec Department, she's a great resource for that and really helps us get contact with those businesses. So, we definitely have tons of cars and tons of booths and it just continues to grow. That might be another thing that we might have to expand some streets or something like that or what we cut off, because it just continues to attract more people each year. De Weerd: And this year it was a lot more successful because instead of the single point entry that they had last year, they had four and that -- that was very popular. We have heard a lot of favorable comments versus last year there was a lot of concern. Nary: Madam Mayor? De Weerd: Mr. Nary. Nary: Just to add to that, Madam Mayor, Members of the Council, we had our debrief meeting yesterday with our special events team and police said no -- no issues at all with the trunk or treat. Everything was very very positive. Like the Mayor said, the multiple entrances was helpful. Probably the only thing they suggested was potentially more -- one or two more food vendors and maybe one or two more porta potties. But, otherwise, Meridian City Council Meeting Agenda November 19, 2019 – Page 40 of 301 Meridian City Council November 6, 2019 Page 8 of 14 very orderly, very well done, no complaints. The Parks Department estimated somewhere between eight to ten thousand people. Milam: Wow. Cavener: What a great problem to have. Thanks. Thank, Jaelahna. Appreciate you being here tonight. Coursey: No problem. B. Public Hearing Continued from October 22, 2019 for Ten Mile Plaza (H-2019-0102) by Huston-Bugatsch Architects, Located at 3110 W. Quintale Dr. 1. Appreciate you being here. Okay. 7-A is a public hearing continued from October 22nd for H-2019-0102. I will turn this over to Bill. Parsons: Thank you, Mayor, Members of the Council. Pleasure to be here with you tonight. Next item on the agenda is the Ten Mile Plaza project. This is a development agreement modification for your review this evening. The site consists of two acres of land, currently zoned C-G and is located on the southeast corner of McMillan and Ten Mile Road. In 2001 this property was annexed in as part of the BridgeTower Crossing Subdivision. As part of that annexation the City Council did require a development agreement. Under their purview of that development agreement any development on the site would need to go through detailed site plan approval. So, rather than go through that process, go through a CUP approval, we had discussions with the applicant and informed them that it may be simpler for them to go through a DA modification and that way if they want to develop the site consistent with the C-G zoning they can just do that through staff level review, rather than having to come back to Planning and Zoning Commission and go through that CUP process. So, this -- one, if they -- it requires that -- your approval this evening, but once the amended DA is in place it gives the applicant the ability to develop the site consistent with the concept plan that you see on your screen this evening. So, I would mention to you that the -- again, the site is a lot and block that was created with the BridgeTower Subdivision. The applicant will be developing the property consistent with the site plan and some elevations and I will get into those a little bit later in my presentation. But this is a phased project. Currently the applicant wants to get started on the most northern pad site there that you see highlighted on this screen to your right. It's a 16 -- or 6,015 square foot multi-tenant building for two restaurants and an associated drive-thru. You can see here that they also have shared parking with the adjacent neighbor to the east and, then, future phase two will consist of a 9,000 square foot building pad and associated parking as well. When this project came through back in -- the existing buildings to -- on the east were developed through a detailed CUP Meridian City Council Meeting Agenda November 19, 2019 – Page 41 of 301 Meridian City Council November 6, 2019 Page 9 of 14 process back in 2006. At that time the access to -- to this development was proposed and approved. So, currently if I can just kind of minimize this at this time and show you the access on Google Earth, you can see what's currently happening on the project. So, access to the site is from a curb cut on McMillan Road. Full access here. And, then, there is a -- essentially a backage road to both the arterial roadways that provides access to, essentially, Ten Mile Road through Quintale and the applicant is sharing that with the adjacent property. In my staff report I had made mention that the applicant would need to submit a shared parking cross-access agreement with us. He did provide that information to me already after he received the staff report from me. So, here are the building elevations that the applicant is proposing this evening. Again, this is for phase one on that portion. If you noticed on the concept plan, the drive-thru is also predominantly located along Ten Mile Road and so in our design standards in our UDC that's required to be screened, either in form of a wall, landscaping, berming, some kind of decorative element to minimize the look of that drive-thru along -- adjacent to an arterial roadway. The applicant is in agreement with that provision as part of the DA and he will work through staff and through the design review process as he gets this process in place. One other item that came up -- and we had quite a few discussions with the applicant -- is the architecture of this building. Because the previous site to the east was required to go through that detailed site plan review, we wanted to make sure that the architecture of this building matched currently what's existing out there with the previous development and so as part of staff's recommendation before you this evening we did require the applicant to -- so, in the upper slide here you can see the main entrance of the building has that gabled parapet -- stoned parapet. Staff's recommendation was that they would mirror that same design element on the rear or the west facade of the building. In discussions with the applicant they put together this rear elevation for you this evening and staff is agreeable to the proposed change that you see here. So, we wanted to make sure that the rear of the building also had the same design elements as the front of the building to give it additional architectural embellishment along the major arterial. So, one, we want to screen the drive-thru and, two, we want the back of the building to look as good at the front of the building, which is consistent with our design standards. So, this -- this -- these are the DA provisions that we are proposing before you this evening. Again, the applicant's removing this property from the boundary of that DA in order to develop the site consistent with the concept plan and the building elevations that were shared with you this evening. The applicant is in agreement with staff's recommended conditions, with the exception of DA provision number two, which, again, staff had a different recommendation in the staff report and we are asking that you strike the last sentence of that provision this evening, as we are amenable to the revised change that the applicant provided to us. Staff did receive written testimony on this application from Dave Steels. They are concerned with the amount of parking within that proposed development and there has been a number of code enforcement cases out there recently. And, then, Diane Oswald also same concern. Parking. And that's why when we did our -- when we analyzed this development we were concerned about the parking and we wanted to make sure that we had some kind of cross-parking agreement, so that we can provide a little additional parking out there. With that staff is recommending approval with the conditions of approval in front of you and I will stand for any questions you may have. We are talking about the rear of the building with this reverse or rear stone parapet. Where on the map is that? Parsons: Good -- good question. Madam Mayor, Members of the Council, it's the west elevation. So, the side that faces Ten Mile Road. Cavener: Madam Mayor. Thanks. That's what I thought you said. I just wanted to get clarification. Thank you. De Weerd: Okay. Any other questions? Mr. Bernt. Bernt: Thank you, Bill. Quick question in regard to the parking. I know that there is some really popular restaurants out there in that area that -- where we don't have enough parking and it's caused some issues with code enforcement and such and so you feel comfortable that -- that there is enough parking and with the potential of this restaurant or whatever that's going in that as a drive-thru will be able to accommodate, you know, potential parking issues in this -- in this area as well? Parsons: Madam Mayor, Members of the Council, Councilman Bernt, yes. Recently a code change went through where we changed our parking standards for restaurant uses and so they are going to have -- their -- the parking that they have shown for that -- for phase one does comply with our restaurant standards, which is one stall per every 250 square feet of gross floor area for the structure. So, they are in excess of what code requires and that's why when they came through what -- that's why this evening I wanted them to also show you the details on the southern portion of the property, so that you can see that there is also going to be additional parking with that pad site in the future, so you can get a full picture of what the build out of that property would -- would look like whenever they are ready to go with phase two. But, yes, I'm comfortable with the amount of parking that they are showing on the site. Bernt: Thank you, Bill. Madam Mayor, follow up. And what just -- just one more question. What was the -- what was the sentence that you were going to strike for the condition of approval? Parsons: Yeah. Madam Mayor, Members of Council, it's DA provision number two. STAFF ANALYSIS The existing Development Agreement (DA) (Inst. ##101117652) for the Bridgetower Crossing development consisting of 371.42 acres of land was approved in 2001. The terms of the original agreement requires each use on the property to obtain detailed CUP approval. Rather than go through the CUP approval, the applicant wishes to amend the development agreement so he can develop the site consistent with the proposed development plan and building elevations. A legal description showing the boundary of the property subject to the new DA terms are included below in Section VII.A. The proposed concept plan depicts two (2) commercial pads and associated parking. The first phase of development consist of the northern pad site. The site is proposed to develop with a 6,015 square foot multi-tenant building to house two (2) restaurants with an accessory drive-through. The second pad site depicts a 9,000 square foot pad and associated parking (see Exhibit VII.B). Both the restaurants and associated are subject to the specific use standards set forth in UDC 11-4-3-49 and 11-4-3-11. To ensure the drive-through is not the main focal point of the development, the applicant should incorporate a berm, additional landscaping, walls, architectural elements or a combination of these design techniques to screen the drive-through in accord with the design standards set forth in UDC 11-3A-19B.3.f. Access is proposed via existing access points from N. Ten Mile Rd., via W. Quintale Dr. and W. McMillan Rd., via the adjacent existing commercial development. Further, the site plan depicts parking that may be shared with the adjacent commercial development on the east boundary of the proposed development. Prior to development on the site, the applicant should submit a recorded reciprocal cross access and shared parking agreement between the proposed and existing development. Access to the site is required to comply with UDC 11-3A-3. Conceptual building elevations were also submitted to demonstrate the quality of design and a cohesive design theme of the future buildings in the development. Building materials consist of three (3) different colors of stucco, stone accents and metal awnings consistent with the neighboring commercial development.
