I am once again apposed to a city project on the corner of McMillan and Goddard
Creek. The new project H-2019-0068 will only add more congestion to our highly
densely, congested and populated area. When Costco, Winco and the widening of 10 Mile
rd start where do you think the cars are going to go to avoid the chaos? Long lake
to Goddard Way and Apgar Creek Dr. McMillan rd is truly non accessible during peak
hours which have now turned into any hours of the day with day light.
There is a planned Meridian Planning and Zoning meeting on October 3rd at Meridian
City hall at 6 pm. A few residence of Kelly Creek know this because of a postcard
from the city not because of any public hearing notice sign. After calling Scott
Noriyuki of Northside on 8/12/2019 6:15 pm after the scheduled meeting time came and
went his response was to the homeowners of Kelly Creek after not showing up or even
canceling the planned August 12th meeting at 6:00 pm that the project was dead. Scott
couldn't even bother to tell all the homeowners that the meeting was canceled.
However in all truth he never filed the paperwork with planning and zoning to get a
public hearing with p&z and put up signs prematurely. Scott had already posted
2 public hearing notice signs that there would be a hearing with p&z on 8-15-19 which
was not the case. The signs are still up in the same spots with the hearing notice
slated for 8-15-19. Scott of Northside has never updated the signs to advise the
public that there is a new date planned for a public hearing on 10-3-19. Residence
thought the project was not going forward do to the meeting with p&z being canceled
for 8-15-2019 and Scott saying he was not going ahead with the project. How can a
meeting go forward with a conflict of dates and times and not following the
guidelines to even have a meeting.
Per City code:
14. For permits that require a public hearing, Applicant posts the site with a public
hearing notice sign a minimum of 10 days prior to the hearing. Affidavit of Posting &
pictures of the posting need to be provided to the City a minimum of 7 days prior to the
hearing. (Posting is not required for UDC text amendment, Comprehensive Plan text
amendment, vacation, Comprehensive Plan map amendment initiated by the City, and/or short
plat applications.) Please see pictures regarding signage taken 9-21-19.
Furthermore the following was also not followed by city code:
2. For permits that require a public hearing, applicant is required to hold a
neighborhood meeting with neighbors and property owners located within 300’ of the
property boundary. The Planning Department Administrative Assistant can provide the list
of property owners. Notice of the meeting must be provided at least five (5) days prior
to the meeting. The meeting shall be held not more than three (3) months or less than
five (5) days prior to submittal of an application. 3. Applicant submits development

application to Planning Department Assistant City Planner per city code and this did not
happen.
When Kelly Creek met on numerous occasions regarding the Goddard Creek apartments H2017-
0007 Mayor Tammy stated after having to do the first tiebreaker in her career that the
property of 5 acres in question would be zoned R-4 and the project for the storage
facility (only) was approved with modifications. Please see meeting on the final decision
6-20-17.
Adding 44 more units on a 4.8 parcel in an already overcrowded area and using Selway
Rapids as it's entrance will become more of a nightmare then it already is in that
area. Since the hoa has deemed Lolo Pass a fire lane things have really gotten out of
hand with parking. The fire lane on Lolo Pass Lane was but their according to our hoa
so a fire truck has the ability to turn around however a fire truck can't even make a
turn on to Apgar Creek off of Goddard Creek because of the parking issues that occur
on and evening and weekend basis. Please see attached photo's. We already have a
serious traffic and parking problem in Kelly Creek and this rezoning from R4 to R15
will only make it worse. Pl ease check with code enforcement and the police department
regarding all the calls made and citations written because of this nightmare. All the
traffic from these 44 units will enter and exit through the Selway (Selway Rapids)
apartments only adding more congestion to our already congested streets and Selways
parking problems, speeding on Apgar Creek and parking violator problems. There is
strength in numbers and the planning and zoning could make a decision in our favor
recommending the project be denied. The lot is 875K for the 5 acres and is priced
that way for a reason R-4 multi use and according to the proposal they just can't fit
all that is required to fulfill what is needed for amenities, parking and building.
Since 1/28/15 according to ACHD our traffic count was 1847 when a new study was done
5-3-2017 and the volume went up to 3308 in a 24 hour period Selway Apartments and
Kelly Creek were established neighborhoods also adding 400 cars a day to Apgar Creek
Dr for an alternative exit. A study done by ACHD needs to be done in 2019 if the
project gets to the council. I am sure it will show an increased volume from 2017.
You can't get out on McMillan Rd off of Goddard Creek because of the traffic volume
from all of the new construction west of these points and the completion of the 10
mile interchange has dramatically increase our traffic flow.This is all public
knowledge and can be found on ACHDs site regarding traffic counts.
In every instance the traffic counters were placed right next to a stop sign so the
true speeds are not accurate in any of the counts. Traffic was either slowing down or
speeding up. We have a speeding problem on both Goddard Creek and Apgar Creek Dr.
Both streets are used by travelers who don't want to fight the Linder-10 Mile rd
congestion during all hours of the day. It's bad enough we have to be inundated with
Selway apartments parking problems and being swore at and flipped the bird when
asking drivers to slow down because be have a ton of children in our neighborhood.
Kelly Creek Park is for Kelly Creek residence and is paid for by Kelly Creek
residence. Many Selway residence use our park because they have no amenities of their
own for children to play except for a pool and clubhouse which is hardly a playground
for tots and youngsters. We don't have a problem as of yet however the signs in our
park clearly state for Kelly Creek residence only. Adding 44 more buildings will mean
a minimum of 88 more cars at the Goddard Creek Way, Apgar Creek Dr and Selway Rapids
streets trying to exit the Kelly Creek subdivision and guess which route they will
choose since you can't make a left turn off Goddard Creek onto McMillan. The cars
stack up and people can't wait 10 minutes to try to get out of their own subdivision
so they use the only alternative route which is Apgar Creek Dr. or go clear back to
Chinden to gain access to get to work. Plus you can add school buses at all hours of
the day.
Approving this rezone to build yet another 44 3 story townhomes should not be allowed
after the outcome of the June 2017 final decision made by the Mayor of Meridian.
