Description
Request to modify an existing development agreement for the purpose of removing the subject
property from DA Instrument #106155843 and to be placed into a new, separate development
agreement
Applicant BVA Development , Inc.
The Idaho Transportation Department (ITD) reviewed the referenced development agreement modification
application and has the following comments:
1. This project abuts the State Highway system.
2. ITD has received, reviewed, and accepted a Traffic Impact Study (TIS) for Victory Commons
Subdivision. As stated in ITD’s TIS acceptance letter dated June 6, 2019, the TIS has shown the need for
mitigation for traffic generated by the development (see attached).
3. An approach is proposed onto SH-69 approximately 1,000 feet north of Victory Road. This approach will
be limited to right-in, right-out. Applicant shall install a concrete keyed in traffic separator Type 1 that
will restrict the approach to right-in, right-out. The traffic separator shall start at Maestra Street and extend
approximately 550 feet south.
4. Applicant shall be required to construct a northbound right turn lane designed to ITD’s standards as part
of the mitigation identified in the TIS. ITD requests a 12 foot dedication of right of way along the
applicant’s parcel. This allows ITD to reconstruct the right turn lane in the future with no cost to the
applicant.
5. The existing approach on SH-69 located approximately 1,300 feet south of Harris Street shall be removed.

6. Applicant must apply for and receive an approved right-of-way use permit prior to doing any work or
activity within the highway right-of-way. Please have the applicant contact Shona Tonkin at 208- 334-
8341 for this permit.
7. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State Highway.
8. The Idaho Administrative Procedure Act (IDAPA) 39.03.60 governs advertising along the State Highway
system. The applicant may contact Justin Pond, Program Manager for ITD’s Headquarters Right-of-Way
Section at (208) 334-8832 for more information.
9. Once the applicant has removed the existing approach, installed the median, and constructed a right turn
lane to ITD current standards, ITD will withdraw any objection to the proposed application.
