Here is an email from NMID regarding the pathways at Whistle Stop. The pathway
mentioned in the email that had already been installed is the one along the railroad tracks. We
were able to work with NMID and leave that pathway in place however, as stated in the email,
they do not want to have "pathway's to nowhere" in their easements which is exactly what a
pathway on the south side of the Nine Mile Drain would be. There is already a path on the
north side of the drain, but adding one to the south would not connect to anything at either our
East or West neighboring properties.
We will discuss with our landscaper options for the landscape islands that have the ADA
ramps in them and follow up with you as Bill mentioned.

Guys,
I found out yesterday for the 1st
time, that a pathway was being paved on our easement for the
Rutledge Lateral. We have not approved any plans and we certainly do not have a Master
Pathway Agreement for this. I am concerned that we have a pathway to nowhere that I will
not be able to get the NMID Board of Directors to agree to, this might end up being only a
paved access road for us. In 2005 NMID agreed to a pathway along the Nine Mile Drain for
this project when it was called Roundtree Sub.
I know we have had discussions about a pathway up towards 3rd
street along the Rutledge and
Nine Mile Drain where the City was seeking a grant to pipe the Rutledge and install a pathway
to where the Nine Mile Drain turns north. However we have some gaps along the Rutledge
from where the Nine Mile Drain turns north to this Whistlestop project of areas that developed
years ago with no pathway. People will be getting on this new pathway and will continue
walking our maintenance road (trespassing).
The pathway is already installed. The Biltmore Company had some confusion on their part but
they have been very cooperative and are willing to do whatever it takes with NMID to clear
this up. Before I go any further with this, I’d like to know what the overall plan is and how all
these gaps will be taken care of? NMID has 2 stretches of open ditch that still require frequent
maintenance to keep the water flowing. The piped section still has to be mowed, sprayed for
weeds, and ridden by the ditch rider.
At this time I am asking for all work within our easement area of the Rutledge Lateral
(Landscaping, etc.) to stop until this all gets cleared up. I would like to know the overall
plan for the pathway so I can explain it to the NMID Board of Directors to see if they are
willing to accept this plan.
