Re:Fence Waiver Application
Dear Ms. Goodwin:
This letter is in response to your fence waiver application for the property
located on Lot 10, Block 6, Observation Point Subdivision, Meridian, Idaho.
In your application you asked to be allowed to reduce the setback from 20-
feet to 10-feet from the street side property line along Lake Creek Road.
Objections were received on your request for a fence waiver from
surrounding property owners, whom were notified in accord ",ith the City's
Zoning and Development Ordinances. A hearing was held by the Planning
Director on November 19, 2004. After consideration of the objections filed
and testimony received at the hearing, it was determined that a waiver would
be allowed for the fence to be placed IS-feet from the sidewalk along Lake
Creek Road, starting just in :front of the side door, with the side fence
connecting to the rear fence at a 45° angle (see attached diagram).
This approval is subject to the conditions noted below. Section 11-1-11 of the
Meridian City Code allows any aggrieved person to appeal this decision. All
appeals shall be filed with the Planning and Zoning Department within fifteen
(15) days after the date of this letter.
1. The face of the fence shall be set a minimum of IS-feet from the
sidewalk along Lake Creek Road. .
2. Yoú must landscape and maintain the ground area between the fence
and sidewalk.
3. The board side of the fence shall face out toward the street(s).
4. You must obtain a building permit for your fence from the City of
Meridian Building Department prior to construction.

5. You must call for an inspection of the fence once you have completed construction.
The City of Meridian has no jurisdiction in the enforcement of the provisions of your
subdivision's protective covenants. We recommend that you obtain approval from your
homeowner's association for this fence location. We also recommend that you contact
Dig-Line at 342-1585 to locate any underground utilities prior to digging or excavating
for your fence posts.

My husband and I have been notified concerning the request trom AshIie Goodwin to
reduce the required distance for their fence from 20 feet to 10 feet on the side yard
setback on tlte street side comer of the lot
We are against the approval of this reduction for both safety and aesthetic reasons. We
would be agreeable to a reduction of 17 feet from the sidewalk. This would allow 5 feet
from the side of the house to the fence line. This has a minimum impact to the safety
issues, allows 1andscaping on the side fTOm the feru::e to the street and provides the
homeowner with a 5 foot walkway on their side yard.
Thank you for this consideration. We look forward to hearing the outcome ofthis
process.

NOTICE IS HEREBY GIVEN, pursuant to the Ordinances of the City of
Meridian and the laws of the State of Idaho, that Ashlie Goodwin has filed with
the Zoning Administrator of the City of Meridian an application for a Waiver from

Dear Ms Allen,
My husband and I have been notified concerning the request from Ashlie Goodwin to
reduce the required distance for their fence from 20 feet to 10 feet on the side yard
setback on the street side corner of the lot.
We are against the approval of this reduction for both safety and aesthetic reasons. We
would be agreeable to a reduction of 17 feet from the sidewalk. This would allow 5 feet
from the side of the house to the fence line. This has a minimum impact to the safety
issues, allows landscaping on the side from the fence to the street and provides the
homeowner with a 5 foot walkway on their side yard.
Thank you for this consideration. We look forward to hearing the outcome of this
process.
