Dear Mr. Moormeister:
Tills letter is in response to your fence waiver application for the property
located at 757 E. Havasupai Street, Meridian, Idaho. In your application you
asked to be allowed to reduce the setback from 20-feet to 8 to 10-feet from
the street side property line along N. Red Horse Way.
We received no objections from surrounding property owners, whom were
notified in accord with the City's Zoning and Development Ordinances.
The City has approved your Fence Waiver, allowing the fence to be located
lO-feet from the street side property line along N. Red Horse Way. This
approval is subject to the conditions noted below. Section II-I-II of the
Meridian City Code allows any aggrieved person to appeal this decision. All
appeals shall be filed with the Planning and Zoning Department within fifteen
(15) days after the date of this letter.
1. The face of the fence shall be set a minimum of 10-feet from the
property line along N. Red Horse Way.
2- You must landscape and maintain the ground area between the fence
and sidewalk.
3. The board side of the fence shall face out toward the street(s)
4. You must also obtain a building permit for your fence from the City
of Meridian Building Department prior to construction. You must also
call for an inspection of the fence once you have completed
construction.

The City of Meridian has no jurisdiction in the enforcement of the provisions
òf your subdivision's protective covenants. We recommend that you obtain
approval from your homeowner's association forthîs fence location. We also
recommend that you contact Dig-Line at 342-1585 to locate any underground
utilities prior to digging or excavating for your fence posts.

We are submitting tills waiver request with hopes of enjoying more of our property,
while not infringing on the sprit or intent of the City of Meridian's Fence Regulations.
We believe conditions exist, that should be taken into consideration in your decision.
We are requesting to construct a six foot high fence, eight to ten feet from the east side walk,
extending to our rear (southern) property line- This configuration is set back from the street at
757 E.Havasupia sixty six feet. Do to the easterly curve to the south of North Red Horse Way, no
visual impairment exist at any intersection, ITom any direction- We are enclosing photo's taken
from various points of view of these intersections.
The proposed fence will be approximately four feet six inches in height at the point it
intersects the house. This is due to the slope angle from sidewalk to foundation. The east fence
will be the only section involved for consideration. Materials and construction design will be per
the standard in tills development.
Your attention in this matter will be greatly appreciated. We plan to move into our new
home Dec. 10", and hope to have tills construction completed.

NOTICE OF APPLICATION FOR FENCE WAIVER
NOTICE IS HEREBY GIVEN, pursuant to the Ordinances of the City of
Meridian and the laws of the State of Idaho, that Donald Moormeister has filed
with the Zoning Administrator of the City of Meridian an application for a Waiver
from the Fence Ordinance regarding his/her property located at 757 East
Havasupai Street, Meridian, Idaho. The applicant proposes a eight (8) to ten
(10) foot setback from property line along East Havasupai Street.
Comments, either for or against, said application must be filed with the
Zoning Administrator within fifteen (15) days after the initial, publication of this
