RE: FENCE VARIANCE REQUEST - 4845 W. Moonlake Drive.
Dear Mr. Shields:
The Fence Variance Committee of the City of Meridian, met at 4:45 P.M., April 9, 2003 in City Hall,
to consider your request for a fence setback variance.
After due consideration, the Committee decided to allow a variance request for you to construct a
six (6) foot tall wooden fence in your side street setback area. There was no opposition to this
variance request from adjacent property owners, who were notified in accordance with City
Ordinance requirements of the variance request.
This approved fence location is as shown on the attached sketch and this approval is
subject to the following conditions:
1. The face of the fence shall be set a minimum of 10 feet - 0 inches from the yard side edge
of sidewalk along N. Valley Green Way.
2. The ground area between the fence and sidewalk shall be landscaped and maintained by
you.
3. The board side of the fence shall face out toward the street(s).
4. The City of Meridian has no jurisdiction in the enforcement of the provisions of your
subdivision's Protective Covenants. We therefore recommend that you obtain approval
from your Homeowner's Association for this fence location.
5. We also recommend that you contact Dig-Line at 342-1585 for location of underground
utilities prior to excavation for your fence posts.
6. Please obtain a building permit for your fence from the GI~y qf fI!1¡ridian Building Department
prior to beginning construction. Please call for an inspection after the fence construction is
completed.

7. "Any aggrieved party may appeal the decision of this committee directly to the City Council
pursuant to subsection 11-15-7 of the City Code. All Appeals shall be filed with the City Clerk
within fifteen (15) calendar days after the decision of the Committee and shall specify the
grounds upon which the appeal is filed. An applicant receiving an approved variance request
is hereby advised to allow the specified fifteen (15) day appeal filing time to pass before
beginning fence installation..

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN, pursuant to 11-9-605 J. 10. of the revised
and compiled Ordinances of the City of Meridian, that the Fence Variance
Committee of the City of Meridian will hold a public hearing at the Meridian City
Hall, 33 East Idaho Street, Meridian, Idaho, at the hour of 4:45 P.M., on April 9,
2003, for the purpose of reviewing and considering the application of Raun
Shields for a variance from the Meridian Fence Ordinance at the property legally
described as follows: Lot 3, Block 2 of Tricia's Subdivision No.2 and known by
the address of 4845 West Moonlake Drive. The Applicant proposes a reduction
of the required distance from 20 feet to 15 feet.
The public is welcome. The Applicant is required to attend. Testimony,
objections, and comments will be heard and considered by the Committee.
A written decision of the Committee will be issued to the Applicant, and
any person requesting in writing a copy of the decision will be furnished one.
Any aggrieved party may appeal the decision of the Committee directly to
the Meridian City Council pursuant to Section 11-2-416 G. 1.

4.1.6 Mailboxes. All mailboxes and stands will be of consistent design, material
coloration. All mailboxes will be supplied by developer and charged to builde
closing of lot.
4.1.7 ~. No fence, hedge or boundary wall situated anywhere upon a Building Lot s
have a height greater than six (6) feet, or other lesser height as the Architecll
Committee may require, above the finished graded surface. Any fence or boundary ,
constructed on or near the lot line common to one or more Building Lots shall
constructed as a "good neighbor" (alternating or open panels) fence or wall. Fenc
using natural landscaping as a visual and/or privacy barrier is strongly encourag,
"Invisible" fencing to conttol and contain dogs is sttongly encouraged and shall
allowed. No fence shall be constructed of any material other than wood nor finished
other than a natural finish, except as may be specifically approved in writing by t
Architectural Committee prior to construction. All fencing and boundary W<L
constructed on any Building Lot shall be of compatible style and material to that oth
fencing constructed adjacent to or abutting such Building Lot, and shall otherwise be ¡
approved by the Architectural Committee. Any and all fencing shall comply with tt
Oty of Meridian building codes.
4.1.8 ~. Exterior lighting, including flood lighting, shall be part of the architecturé
. concept of the Improvements on a Building Lot. Fixtures, stands and all exposec
accessories shall be harmonious with building design and shall be as approved by th,
Architectural Committee prior to installation. Lighting shall be restrained in design, ane
excessive brighmess shall be avoided. Exterior yard lights and posts, as set forth in
landscaping paragraph are required for all front yards.
4.2
Antennae. No exterior radio antenna, television antenna or other antenna of any type shall be
erected or maintained on the Property unless it is approved. by the Architectural Committee and
located or screened in a manner acceptable to said Architectural Committee. Satellite dishes
shall be. allowed on the Property if size and location are subnútted and approved by the
Architectural Committee prior to installation. All such applications will be reviewed on a case-
by-case basis.
Insurance Rates. Nothing shall be done or kept on any Building Lot which will increase the rate
of insurance on any other portion of the Property without the approval of the Owner of such
other portion, nor shall anything be done or kept on the Property or a Building Lot which would
result ill the cancellation of insurance or which would be in violation.

No Further Subdivision. Subject to paragraph 4.19 below, no finally platted Building Lot may
be further subdivided, nor may any easement or other interest therein be granted, unless
applied for by grantor.
~. No sign of any kind shall be displayed to the public view without the approval of the
Architectural Committee except (1) such signs as may be used by Grantor in connection with
the development of the Property and sale of Building Lots; (2) temporary signs naming the
contractors, the architect, and the lending institution for a particular consttuction operation;
(3) such informational signs of customary and reasonable dimensions as prescribed by the
Architectural Committee may be displayed; and (4) one (1) sign of customary and reasonable
dimensions not to exceed three (3) feet by two (2) feet as may be displayed by an Owner other
that Grantor on or from a Building Lot advertising the residence for sale or lease.
Nuisances. No rubbish or debris of any kind shall be placed or pernútted to accumulate
anywhere upon the Property, and no odor shall be permitted to arise therefrom so as to render
the Property or any portion thereof unsanitary, unsightly, offensive or dettimenta] to the
Property or to its occupants, or to any other property in the vicinity thereof or to its occupants.
No noise or other nuisance shall be pernútted to exist or operate upon any portion of the
Property so as to be offensive or detrimental to the Property or to its occupants or to other
