Dear Mr. Raftery:
The Fence Variance Committee of the City of Meridian met in your presence at 4:15 p.m., June
23, 1997, in City Hall to consider this request.
After due consideration, the Committee decided to allow construction of a six (6) foot tall
wooden fence within your side yard setback, as shown on your sketch, subject to the following:
1. The face of the fence shall be set eighteen (18) feet from the yard edge of the sidewalk
along Adkins Street.
2. The area between the fence and sidewalk shall be landscaped and maintained by you.
3. The board side of the fence shall face N. Adkins Street.
4. The City of Meridian has no jurisdiction in the enforcement of the provisions of your
subdivisions Protective Covenants. Since this is a variance to a provision of your covenants
we suggest you also contact your Homeowners Association.
5. Please obtain a fence building permit from City Hall prior to beginning construction.
Thank your for complying with the City ordinance in requesting this variance.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to 11-9-605 J. 10. of the Revised and
Compiled Ordinances of the City of Meridian, that the Fence Variance Committee of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of ....tl§....o'clock .£...M., on Mondav. June 23, 1997, for the
purpose of reviewing and considering the Application of Stephen Rafterv
for a
variance from the Meridian Fence Ordinance at the property legally described as follows:
Lot 11, Block 18 Danburv Fair Subdivision No, 7 and known by the address 1416 E.
Shellbrook Meridian. Idaho 83642. The Applicant proposed to reduce the required
distance from 20 feet to 18 feet.
The public is welcome. Testimony, objections, and comments will be heard and
considered by the Committee.
A written decision of the Committee will be issued to the Applicant and any person
requesting in writing a copy of the decision will be furnished one.
Any aggrieved party may appeal the decision of the Committee directly to the
Meridian City Council pursuant to Section 11-2-416 G. 1.

Outbuildinas: No trailer, truck camper, tent, garage
barn, shack or other outbuilding shall at any' time b~
used as a residen~ temporarily or permanently on any
part of said properties.
Storaae of Vehicles and Eauioment: Parking of boats,
trailers, motorcycles, trucks, truck campers, motorhOmes,
recreational vehicles, and like equipment, or junk cars
or other unsightly vehicles, shall not be allowed on any
lot nor on public ways or Common Area adjacent thereto,
except under such circumstances, if any, as may be
prescribed in writing by, and..in the sole discretion of
the Board of Directors of the Association, which
discretion may not be challenged for having been
exercised unreasonably. All other parking of equipment
shall be prohibited, except as approved in writing by the
Board of Directions of the Association. Any vehicle
awaiting repair or being repaired shall be removed from
the subdivision within 48 hours.
siaht Distance at Intersections: No fence, wall, hedge
or shrub planting which obstructs sight lines at
elevations between three feet (3') and eight feet (8')
above the roadways shall be placed or permitted to remain
on any corner lot within the triangular area formed by
the street property lines and a line connecting them at
points 30 feet from the intersection of the street lines,
or in the case of a rounded property corner, from the
intersection of the street property lines extended. The
same sight-line limitations shall apply on any lot within
ten feet (10') from the intersection of a street property
line with the edge of a driveway or alley pavement.
Leasina Restrictions: Any lease- (as defined below)
between an Owner and his tenant shall provide that the
terms of the lease shall be subject in all respects to
the provisions contained in this Declaration, the
Association's Articles of Incorporation and its Bylaws,
and that any failure by said tenant to comply with the
terms of such documents shall be a default under such
lease. For the purposes of this Declaration, a "lease"
shall mean any agreement for the leasing or rental of a
Dwelling Unit (including. a month-to-month rental
agreement); and all such Leases shall be in writing-
Other than the foregoing, there is no restriction on the
right of any Owner to lease his Dwelling Unit.
Sewer Restrictions: All bathroom, sink and toilet
facilities shall be located inside the Dwelling Unit or

Section 3, Construction Reauirements: Each dwelling
uni t must have at least two exterior lights illuminating the garage
door openings and one exterior light for the front entryway(s).
ARTICLE X. ARCHITECTURAL CONTROL
~~l.') Architectural Control: No building shall be
erec~r altered on any lot until the construction plans
and specifications and a plan showing the location of the structure
have been approved by the committee as to quality of workmanship
and materials, harmony of external design with existing structures,
and as to location with respect to topography and finish grade
elevation. No fence or wall shall be erected, placed or altered on
any lot nearer to any street than the minimum building setback line
unless similarly, approved.
No 9~elling, fence, building, garage or other structure shall
'be built, erected, placed, materially altered or materiall~
repaired which shall alter the surface colors or texture of any
Unit or portion thereof unless and until plãns, specifications and
color scheme have been reviewed in advance by the Committee and the
same'has been approved in writing, conditionally or otherwise. The
requ'Ìrements as to design and color shall apply only to the
exterior appearance of such improvements, it not being the intent
of these restrictions to control interior repair or alteration,
with the exception of alteration of a garage or carport into living
area.
Plans of all structures to be erected on any lot or within the.
Common Area must be submitted to and approved by the Committee. -Su~I\T~
Complete plans and specifications of all proposed buildings and
structures, together with a detailed plan showing proposed location
on a particular lot, shall be submitted to the Committee before any
construction or alteration is commenced, and such construction or
alteration shall not be commenced until approval therefor is given
by the Committee.
