Dear Mr. Petersen:
The Fence Variance Committee of the City of Meridian met in your presence at
4:45 P.M., May 11, 1998, in City Hall to consider this request.
After due consideration, the Committee decided to allow this variance request
to construct a six (6) foot tall wooden fence in your side street setback area
subject to the following:
1. The face of the fence shall be set ten (10) feet from the yard edge of
sidewalk along S. Bayou Bar Way at the southwest property corner and
seventeen (17) feet from the sidewalk edge at your driveway.
2. The ground area between the fence and sidewalk shall be landscaped
and maintained by you.
3. The board side of the fence shall face S. Bayou Bar Way.
4. The City of Meridian has no jurisdiction in the enforcement of the
provisions of your subdivisions Protective Covenants. Since this is a
variance to a provision of your covenants we suggest you also contact
your Homeowners Association for their approval.
5. Please obtain a fence building permit from the City Building Department
prior to beginning construction.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to 11-9-605 J. 10. of the Revised and
Compiled Ordinances of the City of Meridian, that the Fence Variance Committee of the
City of Meridian will hold a, public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 4:45 o'clock P.M., on May 11, 1998, for the purpose of
reviewing and col1$idering the Application of Thomas L. Petersen for a variance from the
Meridian Fence Ordinance at the property legally described as follows: Lot 1. Block 4
Raven Hill Subdivision and known by the address 1865 Doberman, Meridian. Idaho 83642.
The Applicant proposed to reduce the reQuired distance from 20 feet to 10 feet.
The public is welcome. Testimony, objections, and comments will be heard and
considered by the Committee.
A written decision of the Committee will be issued to the Applicant and any person
requesting in writing a copy of the decision will be furnished one.
Any aggrieved party may appeal the decision of the. Committee directly to the
Meridian City Council pursuant to Section 11-2-416 G. 1.

served by the connections shall be entitled to fun use and enjoyment of such portions
of said connections as service such Owner's Building Lot.
10.4 Drivewav Easements. Whenever a driveway is installed within the Property
which in whole or in part lies upon a Building Lot owned by an Owner Qther than the Owner
of the Building Lot served, or installed to serve more than one Building Lot, the Owner of
each Building Lot served or to be served by such driveway shall be entitled to full use and
enjoyment of such other Building Lot as required to service such Owner's Building Lot or to
repair, replace or maintain such driveway.
10.5 Disnutes as to ShariDl! of Costs. In the event of a dispute between Owners
with respect to the repair or rebuilding of utility connections or driveways, or with respect tQ
the sharing of the cost therefor, upon written request of one of such Owners addressed to the
Association, the matter shall be submitted to the Board which shall decide the dispute and. if
appropriate, make an appropriate Assessment against any or all of the Owners involved on
behalf of the prevailing Owner(s), which Assessment shall be collected and enforced in the
manner provided by this Declaration for Limited Assessments.
ARTICLE XI: MISCELLANEOUS
11.1 Term. The easements created hereunder shall be perpetual, subject only to
extinguishment by the holders of such easements as provided by law. The covenants,
conditions, restrictions and equitable servitudes of this Declaration shall run until December
31,2010, unless amended as herein provided. After December 31, 2010, such covenants,
conditions and restrictions shall be automatically extended for successive periods of ten (10)
years each, unless amended or extinguished by a written ins1rument executed by Members
holding at least three-fourths (3/4) of the voting power of the Association and such written
instrument is recorded with the Ada County Recorder. Further provided that the Association
shall not be dissolved without the prior written approval of the City of Boise City and Ada
COImty Highway District, such consent not to be unreasonably withheld provided that a
responsible successor organization shall agree to perform those maintenance responsibilities
arising from applicable city and county governmental requirements,
11.2 FencesIHedges. No fence shall be constructed of any material other than
wood nor finished in other than a natural finish, except as may be specifically approved by
the Architectural Control Committee. No fence shall be constructed so as to extend toward
the front of the Lot past the front plane of the dwelling structure constructed thereon, or close
than ten (10) feet to any side Lot line adjacent to a dedicated street on a Comer Lot. No
fence, wall, hedge, or shrub planting with an elevation above three (3) feet shall be permitted
in front of building setback requirements without special written consent of the Architectural
Control Committee.
