RE: FENCE VARIANCE REQUEST - 2199 West Lowry Street.
Dear Mr. Burford:
The Fence Variance Committee of the City of Meridian, met at 4:30 P.M., September 18, 2002 in
City Hall, to consider your request for a fence setback variance.
After due consideration, the Committee decided to allow a variance request for you to construct a
six (6) foot tall wooden fence in your side street setback area. There no opposition to this variance
request from adjacent property owners, who were notified in accordance with City Ordinance
requirements of the variance request.
This approved fence location is as shown on the attached sketch and this approval is
subject to the following conditions:
1. The face of the fence shall be set a minimum of 10 feet - 0 inches from the yard side edge
of sidewalk along N. Kubik Way.
2. The ground area between the fence and sidewalk shall be landscaped and maintained by
you.
3. The board side of the fence shall face out toward the street(s).
4. The City of Meridian has no jurisdiction in the enforcement of the provisions of your
subdivision's Protective Covenants. We therefore recommend that you obtain approval
from your Homeowner's Association for this fence location.
5. We also recommend that you contact Dig-Line at 342-1585 for location of underground
utilities prior to excavation for your fence posts.
6. Please obtain a building permit for your fence from the City of Meridian Building Department
prior to beginning construction. Please call for an inspection after the fence construction is
completed.

7. "Any aggrieved party may appeal the decision of this committee directly to the City Council
pursuant to subsection 11-15-7 of the City Code. All Appeals shall be filed with the City Clerk
within fifteen (15) calendar days after the decision of the Committee and shall specify the
grounds upon which the appeal is filed. An applicant receiving an approved variance request
is hereby advised to allow the specified fifteen (15) day appeal filing time to pass before
beginning fence installation,"

Notwithstanding the foregoing, any boat, camper trailer or recreational vehicle which
is in good repair and working order which does not exceed the following dimensions may
be stored on the side yard of Lot between front and rear yard set-backs if screened by a
six foot (6') fence: eight (8) feet wide, twenty-seven (27) feet long and ten (10) feet high.
Provided, however, such storage may not be located adjacent to the street on a corner Lot.
2.16 Bathrooms. All bathrooms, sink and toilet facilities shall be inside residence
buildings and shall be connected by underground pipes directly with the sewer system.
2.17 Antennae No television antennae, satellite receivers. or radio aerials shall
be installed on the Property, other than within the interior of a Unit.
2.18 ¡'Hazardous Activities No activity shall be conducted on or in any Unit, Lot
or Common Area which is or might be unsafe or hazardous tD any person or Property.
WIthout limiting the 'generality of the foregoing, no firearms shall be discharged upon said
Property; no open fires shall be lighted or permitted on any property except in a self-
contained barbecue unit while attended and in use for cooking purpDses, orwith a safe and
well-designed interior fireplace, (except such picnic fires in portiDns of said Common Areas
designed for such use or) except such controlled and attended fires required for clearing
or maintenance of land.
2,19 Unsiohtlv Articles No unsightly articies shall be permitted to remain on any
Lot or Common Area as to be visible from any other portion of the Property. Without
limiting the foregoing, no clothing or household fabrics shall be hung, dried or aired in such
a way as to be visible from any other portiDn of the Property. No lumber. grass, shrub or
tree clippings or plant waste, compost piles, metals, building or other materials or scrap or
other similar material or articles shall be kept, stored or allowed 10 accumulate on any
portion of the Property except within an enclosed structure or appropriately screened from
view as approved, in writing, by the Architectural Committee. "Screened" is defined as
being concealed or made non-visible from eye level, at grade, at all points with the
PrDperty.
2.20 Lioht Sound - General No light shall be emitted from any Lot or from
Common Area which light is unreasonably bright or causes unreasonable glare. ~jo sound
shall be emitted from any Lot or Common Area which is unreasonably loud or annoying,
and no odors shall be emitted Dn any property which are noxious or offensive 10 Others.
2.21 Five Mile Underdrain It is understood that said drain shall be completely
covered over. No lot shall enjoy this item as water amenities.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN, pursuant to 11-9-605 J. 10. of the revised
and compiled Ordinances of the City of Meridian, that the Fence Variance
Committee of the City of Meridian will hold a public hearing at the Meridian City
Hall, 33 East Idaho Street, Meridian, Idaho, at the hour of 4:30 P.M., on
September 18, 2002, for the purpose of reviewing and considering the
application of Larry Burford for a variance from the Meridian Fence Ordinance
at the property legally desaibed as follows: Lot 10, Block 14 of Tumble Creek
Subdivision and known by the address of 2199 West Lowry Street. The
Applicant proposes a reduction of the required distance from 20 feet to 7 feet, 4
inches.
The public is welcome. The Applicant is required to attend. Testimony,
objections, and comments will be heard and considered by the Committee,
A written decision of the Committee will be issued to the Applicant, and
any person requesting in writing a copy of the decision will be furnished one.
Any aggrieved party may appeal the decision of the Committee directly to
the Meridian City Council pursuant to Section 11-2-416 G. 1.
