Dear Mr. Borup:
The Fence Variance Committee of the City of Meridian, met at 4:30 P.M., May 7, 2003 in City Hall,
to consider your request for a fence setback variance.
After due consideration, the Committee decided to allow a variance request for you to construct a
six (6) foot tall wooden fence in your side street setback area. There was no opposition to this
variance request from adjacent property owners, who were notified in accordance with City
Ordinance requirements of the variance request.
This approved fence location is as shown on the attached sketch and this approval is
subject to the following conditions:
1. The face of the fence shall be set a minimum of 10 feet - 0 inches from the yard side edge
of sidewalk along West Davenport Street.
2. The ground area between the fence and sidewalk shall be landscaped and maintained by
you.
3. The board side of the fence shall face out toward the street(s).
4. The City of Meridian has no jurisdiction in the enforcement of the provisions of your
subdivision's Protective Covenants. We therefore recommend that you obtain approval
from your Homeowner's Association for this fence location.
5. We also recommend that you contact Dig-Line at 342-1585 for location of underground
utilities prior to excavation for your fence posts.
6. Please obtain a building permit for your fence from the City of Meridian Building Department
prior to beginning construction. Please call for an inspection after the fence construction is
completed.

7. "Any aggrieved party may appeal the decision of this committee directly to the City Council
pursuant to subsection 11-15-7 of the City Code. All Appeals shall be filed with the City Clerk
within fifteen (15) calendar days after the decision of the Committee and shall specify the
grounds upon which the appeal is filed. An applicant receiving an approved variance request
is hereby advised to allow the specified fifteen (15) day appeal filing time to pass before
beginning fence installation."

incIw:ting Common Areas, artistic conformity to the terrain and the other Improvements on the Property,
and any and all other factors which the Architectural Committee, in its reasonable discretion, deem
relevant. Said requirements as to the approval of the architectural design shall apply only to the exterior
appearance of the Improvements. This Declaration is DOt intended to serve as authority for the
Architectural Committee to control the interior layout or design of reaidenûal structures except to the extent
incidentally necessitated by use, size and height restriCÛODS.
4.1.3 Setbacks and Hei2ht. No residential or other structure shall be placed nearer to the
Building Lot lines or buih higher than pennitted by the Plat in which the Building Lot is located, by any
applicable zolring restriction, by any conditional use pennit, or by a building envelope designated either by
Grantor or the applicable Architectural Committee whichever is more restrictive.
4.1.4 Accessorv Strnctures. Detached garages sha1I be allowed if in conformity with the
provisions of this Declaration, and as approved by the applicable Architectural Committee. Garages and
storage sheds shall be constructed of; and roofed with, the same materials, and with similar colors and
design, as the residential structure on the applicable Building Lot No playhouses, playground equipment,
pooIs, pool slides, diving boards, bot tubs, spas, or similar items shall extend higher than five (5) feet above
the finished graded surface of the Building Lot upon which such item(s) are located unless approved in
advance.
4.1.5 Drivewava. All access driveways shall have a wearing SUIface of concrete, or other
bard SUIface materials (if approved in advance in writing by the Architectural Committee), and shall be
properly graded to assure proper drainage.
4.1.6 Mailboxes. All mailboxes will be of consistent design, material and coloration and
shall be located on or adjoiDing Building Lot lines at places designated by Grantor or the Architectural
Committee.
4.1.7 Fencing. No fence or hedge situated anywhere upon a Building Lot sha1I have a ]
height greater than six (6) feet above the :finished graded suri8ce of the Building Lot or Common Area upon
which such fence or hedge is situated. AEj fence constructed on or near the lot line common to one or
more Building Lots sha1I be constructed as a "good neighbor" fence. No fence shall be constructed so as to
extend toward the front of the BuiIdmg Lot past the ftont plane of the dwelling structure constructed
thereon, or closer than ten. (10) feet to any side Building Lot line of a comer of a Building Lot adjacent to a
dedicated street and shall be in compliance with applicable Meridian City ordinances. See Exhibit C for
limitations on materials and style. .
4.1.8 Lie:hting. Exterior lighting, including flood lighting, shall be part of the architectural
concept of the Improvements on a Building Lot. Fixtures, standards and all exposed accessories shall be
harmonious with building design, and shall be as approved by the applicable Architectural Committee.
Lighting shall be restrained in design, and excessive brightness shall be avoided.
4.1.9 Garages. Each dwelling unit shall have an attached or detached fully enclosed garage
adequate for a minimum of two (2), and a maximum of five (5) standard. size automobiles. No carports
shall be allowed. See also Exhibit C.
4.2 Antennae. No exterior radio antenna, television antenna, satellite dish antenna or other antenna
of any type sh~ll be erected or maintained on the Property unless it is located or screened in a manner acceptable to
the applicable Architectural Committee. .

4.3 Insurance Rates. Nothing shall be done or kept on any Building Lot which will increase the rate
of insurance on any other portion of the Property without the approval of the Owner of such other portion, nor shaH

the Revised and Compiled Ordinances and the procedure for such a variance shall not be governed

proposed fence;
An application fee established by resolution of the Council;
Upon receipt of the fence variance application the Zoning Administrator shall set a hearing
and see that notice is mailed by flfSt class mail to all owners of property within 200 feet of
the radius of the subject property, which hearing shall be held not sooner than 15 days after
the mailing of the required notice and not more than 30 days after mailing of the required
notice. The notice of Hearing does not need to be published in the official newspaper.
The hearing established by this subsection shall be conducted by the fence variance
committee, which committee shall be comprised of the City Engineer, the Meridian Police
Clùef, one Council Member and one Planning and Zoning Member. A quorum of said
committee shall be a minimum of three members of the committee.

Upon hearing the request for the fence variance, the committee shall either approve or deny
or approve with conditions, the application for fence variance; that no written fmdings of
fact shall be required but a written decision shall be written to the applicant and to any party
requesting written notification of the decision at the hearing.

City Council pursuanttoSection 11-2-416 G., 1.

Building Lot lines or built higher than permitted by the Plat in which the Building Lot is located, by any
applicable zoning restriction, by any conditional use permit, or by a building envelope designated either by
Grantor or the applicable Arcbitectural Committee whicheyer is more restrictive.
4.1.4 Accessorv Structures. Detached garages shall be allowed if in conformity with the
provisions of this Declaration, and as approved by the applicable Architectural Committee. Garages and
storage sheds shall be constructed of, and roofed with, the same materials, and. with similar colors and
design, as the residential structure on the applicable Building Lot No playhouses, playground equipment,
pools, pool slides, diving boards, hot tubs, spas, or similar items shall extend higher than five (5) feet above
the finished graded surface of the Building Lot upon which such itern(s) are located unless approved m
advance.
4.1.5 Driveways. All access driveways shall have a wearing surface of concrete, or other
hard surface materials (if approved in advance in writing by the Architectural Committee), and shall be
properly graded to assure proper drainage.
4.1.6 Mailboxes. All mailboxes will be of consistent design, material and coloration and
shall be located on or adjoirring Building Lot lines at places designated by Grantor or the Architectural
Committee.
4.1.7 Fencing. No fence or hedge situated anywhere upon a Building Lot shall have a
height greater than six (6) feet above the finished graded surface of the Building Lot or ConnDon Area upon
which such fence or hedge is situated. AIIy fence constructed on or near the lot line cornmon to one or
more Building Lots shall be constructed as a "good neighbor" fence. No fence shall be constructed so as to
extend toward the front of the Building Lot past the front plane of the dwelling structure constructed
thereon, or closer than ten (10) feet to any side Building Lot line ora corner of a Buildmg Lot adjacent to a
dedicated street and. shall be in compliance with applicable Meridian City ordinances. See Exhibit C for
limitations on materials and style.
4.1.8 Lighting. Exterior lighting, mcluding flood lighting, shall be part of the architectural
concept of the Improvements on a Buildmg Lot. Fixtures, standards and all exposed accessories shall be
harrnouious with building design, and shall be as approved by the applicable Architectural Committee.
Lighting sbJill be restrained in design, and excessive brightness sbJill be avoided.
4.1.9 Garages. Each dwellmg unit shall bJive an attached or detached fully enclosed garage
adequate for a minimum of tWo (2), and a maximum of five (5) standard size automobiles. No carports
shall be allowed. See also Exhibit C.
4.2 Antennae. No exterior radio antenna, televIsion antenna, satellite dish antenna or other antenna
of any type sh~lI be erected or maintained on the Property unless it is located or screened in a manner acceptable to
the applicable Architectural Committee.
4.3 Insurance Rates. Nothing shall be done or kept on any Building Lot which will increase the rate
of insurance on any other portion of the Property without the approval of the Owner of such other portion, nor shall

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN, pursuant to 11-9-605 J. 10. of the revised
and compiled Ordinances of the City of Meridian, that the Fence Variance
Committee of the City of Meridian will hold a public hearing at the Meridian City
Hall, 33 East Idaho Street, Meridian, Idaho, at the hour of 4:30 P.M., on May 7,
2003, for the purpose of reviewing and considering the application of Borup
Construction, Inc. for a variance from the Meridian Fence Ordinance at the
property legally described as follows: Lot 14, Block 6 of Bear Creek Subdivision
and known by the address of 717 West Davenport Street. The Applicant
proposes a reduction of the required distance from 20 feet to 10 feet.
The public is welcome. The Applicant is required to attend. Testimony,
objections, and comments will be heard and considered by the Committee.
A written decision of the Committee will be issued to the Applicant, and
any person requesting in writing a copy of the decision will be furnished one.
Any aggrieved party may appeal the decision of the Committee directly to
the Meridian City Council pursuant to Section 11-2-416 G. 1.
