Jivan Morgan, T-Zers FROM: Stephanie Leonard, Associate City Planner SUBJECT: T-Zers Shop/Warehouse – CZC, DES (A-2018-0172 and A-2019-0125) Prestige Worldwide Property Management, LLC. OWNER: DESCRIPTION OF APPLICANT'S REQUEST The applicant, Rick Bugatsch, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval to construct a new shop/warehouse building to the east of an existing building on 0.28 acres of land in the C-C zoning district. The new building is to be used as an accessory flex space to the existing retail space. The primary use of the site will be encompassed in the existing retail building; the flex space shall be an ancillary use. Future use of both spaces shall reflect this approval. Revision 1 (February 20, 2019): The applicant, Jivan Morgan, is requesting a revision to the original DES approval to include revised building elevations. The revisions include stucco and cultured stone on the front entrance and façade (west side of the building). The three (3) remaining facades of the building (north, south, and east) are proposed to include metal with modulation, windows and a door for deliveries and access to inventory. The building is situated at the back of the subject site, approximately 70 feet from the public right-of-way (Main St.) and out of sight of neighboring properties. Landscaping and fencing is proposed along the east side of the building, which will provide a screen to the neighboring residential properties (parcel numbers S1107223150 and S1107223160). Solid fencing shall be required to provide adequate screening to the abutting residential properties. Revision 2 (April 3, 2019): The applicant has submitted a DES application to revise the originally approved landscape plan (A-2018-0172). The revised landscape plan includes six (6) arborvitae trees along the east boundary of the site and three (3) variegated dogwood shrubs along the north boundary. Typically, Class I, II or III trees are required within landscape buffers to adjoining uses per UDC 11-3B-9C.1. The applicant is proposing to install landscape materials outside of those requirements for the north and east boundary of the site due to site constraints. Staff has determined that the proposed plantings will meet the intent of City code if landscaped in accord with the water conserving design standards in UDC 11-3B-5O (please see information detailed on the next page); landscaping shall reflect these standards upon inspection and prior to certificate of occupancy. In accord with UDC 11-3B-9C-1.c, the applicant is required to install a 6-foot fence to screen the commercial use from the residentially zoned property to the east, unless the applicant would prefer to install trees to screen the property. Approved screening materials include wood, vinyl or other durable materials; chainlink fencing with slats does not qualify as a screening material. REVISION 2 Conditions Document 2 T-Zers Shop/Warehouse REV 2 – CZC, DES - A-2019-0125 UDC 11-3B-5O: Water Conserving Design: To qualify for the exceptions for water conserving designs as set forth in this chapter, the applicant shall demonstrate the following: 1. The design includes water conserving trees as set forth in table 11-3B-5-1 of this section. 2. The design includes plants that can thrive in climates with approximately ten (10) to twelve inches (12") of annual rainfall. 3. Lawn and turf areas shall not comprise more than fifty percent (50%) of the total landscaped areas and shall consist of water conserving grasses, including, but not limited to, buffalo grass, blue gamma grass, compact fescue, zerilawn, and/or rhyzomotuous tall fescue. 4. Herbaceous and/or perennial ground cover shall be drought tolerant and able to withstand dry conditions once established. As a guide, refer to the recommended plants in the city of Boise parks and recreation "Water Conservation Guidelines". (Ord. 11-1493, 9-6-2011, eff. 9-12-2011) The applicant is also submitting an updated site plan to include an ADA ramp as required by International Building Code. The revised site plan includes an approximately 5 x 10 ft. ramp which will be installed within necessary back-out space for at least one (1) of the seven (7) proposed parking spaces between the new and existing buildings. The applicant’s architect has verified that the seventh space will not be operable with the new ramp and will not be counted toward the required number of spaces. The proposed building is approximately 2,000 square feet which requires four (4) parking spaces be provided per parking standards for the C-C zoning district; three (3) parking spaces are available for the existing building which is approximately 1,300 square feet and requires three (3) spaces. The applicant is proposing to provide nine (9) total spaces on the site, which exceeds the requirement of seven (7) for the C-C zoning district. The applicant shall be required to provide nine (9) spaces unless the ADA ramp requires additional space, should this occur the applicant shall notify the Planning Division prior to inspection and certificate of occupancy. The site is located at 1510 N. Main Street. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. Site Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. REVISION 2 Conditions Document 3 T-Zers Shop/Warehouse REV 2 – CZC, DES - A-2019-0125 Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-5C-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-5C-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11- 3B-14A. 4. The site/landscape plan prepared by Houston & Bugatsch on May 9, 2018, labeled A1.0, is approved by the City of Meridian Planning Division as shown in Exhibit B. 5. The landscape plan prepared by Dave Fitzgerald at the Lawn. Co. on February 28, 2019, labeled “1 Tzers” is approved by the City of Meridian Planning Division as shown in Exhibit D with the following revisions/conditions: a. The applicant is proposing landscaping that differs from the requirements in UDC 11-3B-9C since there is a City of Meridian sewer easement located within the required 20-foot landscape buffer along the eastern part of the property and the northern boundary will not be visible from N. Main St. The applicant is required to adhere to a water conserving design which will require additional vegetation be added to the revised landscape plan, in compliance with UDC 11-3B-5O. Landscaping shall reflect these standards upon inspection and prior to certificate of occupancy. b. The applicant is required to install a 6-foot tall fence to screen the commercial property from the residentially zoned property to the east. Materials shall be consistent with approved screening materials (vinyl, wood, other durable materials); chainlink with slats is not a permitted screening material. 6. The elevations prepared by Houston & Bugatsch on May 9 July 16, 2018, labeled A2.0, are approved by the City of Meridian Planning Division as shown in Exhibit C. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 8. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-18, Flex Space. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before June 15, 2018, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-5A-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION The Certificate of Zoning Compliance shall expire if the construction, alteration or the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until May 31, 2019.
