BY THE CITY COUNCIL:
BIRD, DONNELL, ROUNTREE, WARDLE
A RESOLUTION APPROVING A WARRANTY DEED FROM AUTUMN FAlRE
LLC (GRANTOR) TO THE CITY OF MERIDIAN CITY (GRANTEE) FOR
APPROXIMATELY 7.1 ACRES OF REAL PROPERTY IN THE TRICIA'S CROSSING
SUBDIVISION FOR A FUTURE NEIGHBORHOOD PARK, AUTHORIZING THE
CITY CLERK TO RECORD SAID DEED IN THE REAL PROPERTY RECORDS OF
ADA COUNTY, IDAHO, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the conditions of approval for the annexation and zoning of the
Autumn Faire Subdivision (AZ-00-009), the developer agreed to transfer title to approximately
7.1 acres of real property valued at $204,000.00 in exchange for a waiver of park impact fees
associated with the project; and
WHEREAS, representatives from the Department of Parks and Recreation ofthe City of
Meridian have inspected the subject property and determined that the condition of the property is
acceptable to the City; and,
WHEREAS, the First American Title Insurance Company has issued a Commitment for
Title Insurance for the subject property on terms acceptable to the City.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN CITY, IDAHO:
Section 1. That the Warranty Deed from Autumn Faire LLC, a copy of which is
attached hereto and incorporated herein by reference, be and the same is hereby approved as to
both form and content.
Section 2. That the City Clerk be, and he hereby is, authorized to record said
Warranty Deed in the real property records of Ada County, Idaho for and on behalf ofthe City of
Meridian.
Section 3. That this Resolution shall be in full force and effect immediately upon
its adoption and approval.

WARRANTY DEED
AUTUMN FAIRE LLC, an Idaho Limited Liability Company, GRANTOR, hereby conveys, grants and warrants to
THE CITY OF MERIDIAN, a Municipal Corporation orjlamzed and existing under the laws ofthe State ofldaho,
with its principal offices at 33 East Idaho Avenue, MeridIan Idaho 83642, GRANTEE, for good and valuable
consideration, the following described real property in Ada County, State ofldaho, more particularly described as
follows, to wit:
Lot 2, Block 4 ofTricia's Crossing Subdivision, according to the official Plat thereof, filed in Book 90 of
Plats at Page 10615, Official Records of Ada County, Idaho.
SUBJECT TO taxes and assessments for tbe current >,ear and all subsequent years, together with any and all
existinjl easements, rights-of-way, reservations, restrictions and encumbrances of record, to any existing
tenancies, to all zoning laws and ordinances, and to any state off acts an accurate surveyor inspection oftbe
premises would show.
This conveyance shall include any and all appurtenances, tenements, hereditaments, reversions, remainders,
easements, rights-of-way and water rights in anywise appertaining to the property herein described.
The Grantor covenants to the Grantee that Grantor is the owner in fee simple of said premises; that the premises are
free from all encumbrances, excepting those as may be herein set forth, and excepting those of record, and that
Grantor shall warrant and defend the same from all lawful claims.
