05-464 Warranty Deed Autumn Faire CITY OF MERIDIAN RESOLUTION NO. ()t) - 46 'f-' BY THE CITY COUNCIL: BIRD, DONNELL, ROUNTREE, WARDLE A RESOLUTION APPROVING A WARRANTY DEED FROM AUTUMN FAlRE LLC (GRANTOR) TO THE CITY OF MERIDIAN CITY (GRANTEE) FOR APPROXIMATELY 7.1 ACRES OF REAL PROPERTY IN THE TRICIA'S CROSSING SUBDIVISION FOR A FUTURE NEIGHBORHOOD PARK, AUTHORIZING THE CITY CLERK TO RECORD SAID DEED IN THE REAL PROPERTY RECORDS OF ADA COUNTY, IDAHO, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the conditions of approval for the annexation and zoning of the Autumn Faire Subdivision (AZ-00-009), the developer agreed to transfer title to approximately 7.1 acres of real property valued at $204,000.00 in exchange for a waiver of park impact fees associated with the project; and WHEREAS, representatives from the Department of Parks and Recreation ofthe City of Meridian have inspected the subject property and determined that the condition of the property is acceptable to the City; and, WHEREAS, the First American Title Insurance Company has issued a Commitment for Title Insurance for the subject property on terms acceptable to the City. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN CITY, IDAHO: Section 1. That the Warranty Deed from Autumn Faire LLC, a copy of which is attached hereto and incorporated herein by reference, be and the same is hereby approved as to both form and content. Section 2. That the City Clerk be, and he hereby is, authorized to record said Warranty Deed in the real property records of Ada County, Idaho for and on behalf ofthe City of Meridian. Section 3.
