I. SUMMARY DESCRIPTION OF APPLICANT'S REQUEST
The Planning Division of the Community Development Department has applied for a Zoning
Ordinance Amendment (ZOA) to amend the text of certain sections of the Unified Development Code
(UDC) pertaining to fencing adjacent to pathways & open space; common driveways; irrigation
easements, off-street parking; home occupations; definitions for vehicles; vehicle sales or rental
landscaping; public hearing notice signs; allowed uses in the Industrial districts and other
miscellaneous clean-up items. Please see Section VII below for a complete list
of the proposed (lDC
amendments.
II. SUMMARY RECOMMENDATION
Staff recommends approval of the proposed text amendments to the UDC based on the analysis
provided in Section VII and the Findings of Fact and Conclusions of Law listed in Exhibit B.

V. PROCESSFACTS
A. The subject application is for a Unified Development Code amendment as determined by City
Ordinance. By reason of the provisions of the Meridian City Code Title 11 Chapter 5, a public
hearing is required before the Planning & Zoning Commission and City Council on this matter.
B. Newspaper notifications published on: October 21,2013 and November 4,2013
C. A public service announcement was broadcast fa.xed/emailed on October 10, 2013 regarding this
application.
VI. COMPREHENSTVE PLAII POLICIES AND GOALS
The City's Comprehensive Plan is a vision and policy document for guiding development and the
transportation needs in the City of Meridian. Staff finds that the subject Unified Development Code
Amendment complies with and fuithers the goals and objectives of the 2002 Comprehensive Plan.
The specific objectives and actions that support the proposed amendment are listed below:

The proposed UDC amendments reflect the current trends in development, so as to implement the
intent of the Comprehensive Plan, while not compromising hfe, safety or the general welfare of
the community.
"Support redevelopment opportunities in downtown."
The changes to the parking standards proposed with the Zoning Ordinance Amendment are
intended to simplify the parking standards in the downtown and provide more clarity and
flexibility in the city's parking requirements. These changes are intended to facilitate
redevelopment in the downtown.
"Elevate/enhance quality of residential site and subdivision planning."
The modifications to the common driveway standards presented in this application will
encourage innovative residential site design. Common driveways reduce access points to streets
and create a more diyerse streetscape.
"Develop Meridian as an economic development driving force that creates dynamic, sustainable
and synergistic environments through the development of industrial corridors and target markets."
This application is proposing to remove several uses from industrial
zones that are currently
listed as allowed or conditional uses. The intent of these changes is to preserve the city's
industrial parks as oreas for job
creating uses that support Meridian's economic viability.

The applicant has identified specific sections of the UDC that should be amended for the code to
function efficiently and to more appropriately meet the needs of our customers and the City. This
application includes changes to the following sections of the UDC:

Development Code
l. Unified Development Code Text Amendments:
Upon recommendation from the Commission, the Council shall make a full investigation
and shall, at the public hearing, review the application. In order to grant a text amendment
to the Unified Development Code, the Council shall make the following findings:
A. The text amendment complies with the applicable provisions of the comprehensive plan;
Staff finds that the proposed zoning ordinance amendment complies with the applicable
provisions of the Comprehensive Plan. Please see Comprehensive Plan Policies and Goals,
Section 6, of the Staff Report for more information.
B. The text amendment shall not be materially detrimental to the public health, safety, and
welfare; and
Staff finds that the proposed zoning ordinance amendment will not be detrimental to the
public health, safety or welfare. It is the intent of the text amendments to further the health,
safety and welfare of the public.
C. The text amendment shall not result in an adverse impact upon the delivery of services
by any political subdivision providing public services within the City including, but not
limited to, school districts.
Staff finds that the proposed zoning ordinance amendment does not propose any significant
changes to how public utilities and services are provided to developments. All City
departments, public agencies and service providers that currently review applications will
continue to do so. Please refer to any written or oral testimony provided by any public service
provider(s) when making this finding.

Thank you for taking time yesterday to discuss the proposed UDC text amendments (ottached)
with David
Turnbull and myself; specifically, the addition of easement Paragraph Cto Section 77-3A-6 - Ditches, Loterals,
Canals or Drainooe Courses.
Even with your explanation, we are concerned with the proposal. ln fact, we believe that it is more likely to
set up conflicts with irrigation districts and lead to unintended consequences for a problem that may not
exist. We have also discussed the matter with our engineering consultant, legal counsel and development
staff, and several BCA members with resulting uncertainty.
Because of that uncertainty and, because the matter has not been fully vetted by the Building Contractors
Association, we request that proposed amendment 11-3A-6.C be remanded to staff, allowing the opportunity
for staff to meet with BCA developer members and their engineers to discuss the issue in depth and to find a
mutually agreeable solution-if, in fact, such is required.
Due to scheduling conflicts, Brighton will not be represented at this evening's hearing but we trust that staff
will support this request in its presentation to the Commission.

Thanks for sending the proposed amendments over.
A couple of comments regarding the changes to the industrial uses.

todifferenttournaments. Mostofthegymswegotoareinindustrialdevelopments. lthinkthereisatrendinlocating
sports facilities in industrial areas. I see basketball, cross-fit, fitness clubs and other such recreationalfacilities in
industrial areas. Locally there is the go-cart track at Franklin and Cloverdale. The two indoor soccer centers and a few
gymnastics facilities. I think the Y Homecourt is zoned lL? I really think that recreational facilities should be in light
industrial areas.
I have also seen glass-blowing and metal sculpture studios in industrial areas. Maybe those items are considered an
Artist Studio, so they would be allowed. Many times they can't afford to go anywhere other than industrial areas.
Church or olace of religious worship. We typically do not lease to churches, but we did sell an industrial building to a
church in Nampa and it has worked out well for them. There are issues with parking and incompatibility with heavy
truck traffic, but I am not sure I would change the current Conditional Use permit requirement for churches in an lL
zone. I would prohibit a church in an l-H zone. Again the Y Homecourt building has a church located in it. ln many cases
there is not a conflict since churches typically are busy on the weekend and only on certain evenings during the
week. So in the right situation I think a church can work in an lL zoned area.

qualifies as an urban farm. We may end up with indoor marijuana growing facilities down the road, so you probably
want to keep that option open.
I'm not sure I see any of the proposed changes to the l-L and l-H uses as real pressing issues and wonder if it is even
worth proposing the change. I agree with the R.V. Park exclusion. A park full of people could become
a real problem if
the industrial use produced any noise or smell.
