Size of property, existing zoning, and location: This property consists of 14.94 acres of land, zoned R-4,
located south of E.
McMillan Road & west of N. Eagle Road.
History: This site was annexed in 2005 and included in the preliminary plat &
planned development (PD) for Zebulon Heights
subdivision.
Summary of Request: The proposed plat consists of 40 building lots & 7 common/other lots on 14.94 acres in an R-4 zoning dishict.
The proposed density is 2.68 dwelling units/acre consistent with the reduced density approved with the PD. All
proposed lotjmeet the
dimensional standards of the R-4 district.
Access to the portion of the plat that is south of Settlels canal is
proposed internally via previous phases of Zebulon Heights
subdivision. The area north ofthe canal will be accessed via an existing stub street in Madison Park subdivision at the noilheast
boundary of the site. A pedestrian bridge is proposed over the Settlels
canal for access from the northern portion of the site to the
amenities in Zebulon Heights, to the south.
Open space (11.8%) & site amenities (an extra 5% open space & parkways)
are proposed within lhe site in accord with UDC
standards.

iii Staff recommends instead of shiking condition #1.1.3d as the Commission recommended, the applicant relocate

trees elsewhere within the site outside of any easements; other landscaping is still required in the common lot
adjacent to the
pathway.
iv, The applicant requests a waiver.to UDC 11-3A-6, which requires piping of
the Settler's Canal, to allow the canal to remain open
due to its large capacity; the applicant states it would require a72; pipi (conditions #1.2.4
& i.6).
