Eagle Road & E. Fairview Avenue. Background: At the time of annexation in 2008 when the original concept plan was approved, CenterCal did not own the northem portion of the site. Since that time, they have acquired the property, Summary of Request: The applicant proposes a new conceptual development plan that includes a mixed-use lifestyle center, a retail center, and a residential area. The new concept plan depicts retail - between 532,986 and 974,000 s,f,; offlce - between 43,500 and 136,000 s.f.;and residential- between 140 and of 175 units. The applicant proposes changes to the text of the agreement as follows: 1) minor edits to reflect timing of amended DA; 2) updated references to new design standards, except where specifically noted; parking standards from the original DA will still be applicable; 3) minor edit to clarify that additional residential housing does not require modification of the DA; and edits to reflect phasing of the development. Written Testimony: Deborah Nelson, applicant (response to staff report) Outstanding lssue(s) for City Council: The applicant requests Section 7 of the DA be modified to read, '"COMPLIANCE PERIOD: This Agreement must be fully executed within two (2) years after the date of the Findings for the Development Aoreement Modification aoplication or it is null and void; in such event, the Original Development Agreement shall control."
