and the retainage of the remainder to satisfy the Warranty Surety requirements.

Attached is a copy of Warren Stewart's final acceptance letter for the above named subdivision,
which officially signifies that the required development improvements that were subject to the
performance sureties have been completed. Also attached is an email string between myself
and the developer where he requests that we simply hold back the Warranty Surety amount
from the refund of the Performance Surety.
At this time I am requesting that you initiate the process of refundin 951,27,143.53
of the cash
surety on deposit with the City of Meridian. This amount is the balance of the Performance
Surety after withholding the required Warranty Surety amount of 539,461.40.
The applicant's representative has requested that he be notified by phone when the check is
ready, as he would like to come pick it up in person. His name is Don Newell, 208-404-2161.

The following regulations shall govern the type, location, and construction of all fences:
A. General standards:
1. When a fence is erected not in conjunction with a building permit for a principal use or building, a separate
building permit is required.
2. Electric wire fencing shall be prohibited
3. Barbed wire fencing shall be prohibited, except in the C-C, C-G, M-8, I-L, and I-H districts when: a) used
as the top section for security fencing; and b) located a minimum of six feet (6') above grade to the bottom
wire.
4. The use of boxes, sheet metal, old or decayed wood, broken masoffy blocks, or other like unsightly
materials for fencing shall be prohibited.
5. No fence shall obstruct access to public utility boxes, meters or other infrastructure.
6. Fences shall be kept free from advertising and graffiti and maintained in good repair,
7. Regulations for fences along pathways and common open space areas are set forth below
a. The developer is responsible for constructing fences adjacent to micropath connections to distinguish
common from private areas.
b. Fences adjacent to all pathways and common open space shall be:
l) An open vision fence up to six feet (6') in height, as it provides visibility from adjacent homes or
buildings; or
2) If closed vision fencing is used, it shall not exceed four feet (4') in height. This does not allow four
feet (4') of closed vision fence with two feet (2') of open vision fencing.
c. These restrictions are intended to apply to fencing along interior common open space areas and
pathways. They are not intended to apply to street buffers or entryway landscaping strips. These
restrictions are not intended to require fencing on interior common open space.
8. A fence constructed in the public right of way shall require a license agreement from the transportation
authority.
9. If an owner or applicant desires to obtain an altemative compliance from the provisions of this section, the
procedure shall be in accord with chapter 5, "Administration", of this title.
10. See subsection 1l-3A-682 of this article for additional fencing requirements along irrigation ditches,
laterals, canals, and/or drains.
1 1. Where screening is required in this title, chainlink fencing with or without slats does not qualifu as a
screening material.
B. Additional standards in the C-N, C-C, C-G, M-E, H-8, I-L, and I-H districts:

Dear Sonya:
Per City UDC requirements, I have visited the site and confirmed the Phase 1 landscape, street lighting and
fencing has been completed, in general conformance with the approved plans, with the following exceptions:
1. Upon field inspection of the area west of the basketball court it is my opinion that the area is too
narrow for the proposed locust tree, and as such root damage to the court or the adjacent.. r.-.*-
curb/sidewalk is potential. We request that location for that tree be adjusted as indicated on the
attached sketch.
2. Again upon field inspection, the narrow strip (approximately 3-feet) of grass proposed on the north
and south side of E. Coastline Street is so narrow that mowing and irrigation will be a maintenance
concern. There will eventually be a fence along the Ci!/s Water Tank site (currently under
construction) and likely on the north side of the street as well, compounding this maintenance
concern. As such, we are requesting that these two areas be surfaced with crushed, ornamental
gravel instead ofthe grass as approved on the plan (see sketch).
fu we discussed, by phone, on May 6,20L4, our intention has been that the lawn and street tree(s) in the
parkway planters be installed along with the individual lot development. The builders will be required to
adhere to the approved landscape plan for the landscape installations.
With the requested modifications in items #1 and #2 above, we request that the City accept the installation as
complete and issue the requested certificates of occupancy. We also are requesting release of the develope/s
landscape surety.

Yes, I would work with you on a replacement surety during the warranty period.
The trigger date for the warra nty period is the date of the final acceptance letter. ln otherwords, two years
from the date of the acceptance letter date.

Tradewinds #1. I am now able to process the release of the Performance Surety and issuance of the
Final Acceptance letter, but prior to releasing them I need to receive the Warranty Surety.

Surety amount is detailed on page 3 of the agreement.

As a follow up to our meeting and your e-mail below I wanted to send everyone an updated site plan (attached) to make
sure we are all on the same page. As you know a few new things came to light, and below is a brief discussion of how
we are dealing with the items discussed:
L. Floodplain - We are working with David to submit a floodplain application and study for his review. We hope to
have that submitted later this week.
lrrigation Ditches - We are going to pipe the irrigation ditches, including the ditch
along the eastern boundary
Lot 16, Block 1 Pathway - The attached exhibit shows our plan for this area. We intend to create two open space
lots on what was Lot 16 (lt's now Lot 1 and 2). The intent of the two lots is to keep Lot 1 for open space and a
pathway and for lot 2 to potentially be conveyed to the homeowner it is adjacent to. Since Lot 2 could
potentially not be a part of the subdivision, we added common lots overthe water and sewer mains as required
andincreasedthesizeofthelotwherethebasketballcourtanddrainageisgoing. Theresultingareakeepsus
over the 10% open space requirement even if Lot 2 is not part of the subdivision.
4. Public Works - I am working with Clint to get the approach to the City property, water lines,
and sewer service
coordinated.
Sonya, we have an updated landscape plan that includes the fencing. We will have it over to you later today or first
thing in the morning.
