CZC-14-033 DES-14-034 WILLAMETTE DENTAL BUILDING\\' CERTIFICATE OT' ZONING COMPLIANCE REPORT d'ftKy DATE: TO: FROM: SUBJECT: OWNER: May22,2014 John Skourtes Bill Parsons, Associate City Planner Willamette Dental Building - CZC-14-033 and DES-14-034 Clay LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval to construct a new 8,544 square foot dental office building on 0.73 acres of land in the L-O zoning district. The site is located at 1075 and 1091 S. Wells Street. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Nole: This is no1la building permit. You must complete this process before you commence the use or any construction. Please contact Building Services at (208) 887-2211 to verify the building permit and/or inspection requirements. Site Conditions of Approval 1. Prior to the issuance of a building permit, the applicant shall obtain Planning Division approval of the following applications: 1) a property boundary adjustment application to consolidate Lots I and2, Block I AIID; 2) a vacation application to vacate the l0-foot wide public utilities, drainage and irrigation (PUDD easement platted on the common lot line of Lots I and2, Block l. 2. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC ll-3A-7 and I l-34-68. 3. Business hours of operation within the L-O district shall be limited from 6 am to l0 pm as set forth in UDC ll-28-3A4. Process Conditions of Approval l. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC l1-5C-3B. A surety agreement may be accepted for other improvements in accord with UDC I l-5C-3C. Conditions Document Willamete Dental Building - CZC-14-033 and DES-14-034 3. The site plan prepared by Consulting Structural Engineers, dated March 31,2014, labeled A1.l is approved by the City of Meridian Planning Division on May 22, 2014 with the following changes: a, Provide a bike rack near the entrance ofthe facility in accord with UDC 11- 3C-5C and UDC 11-3C-6G. Include the bike rack detail on the plans submitted to the Building Division. b. Install wheel stops in the parking stalls on the south and east side ofthe building in accord with UDC 1l-3C-5B.3. c. Extend a S-foot wide pedestrian walkway from E. Wells Circle sidewalk to the existing 5-foot wide sidewalk on the east side ofthe proposed development in accord with UDC 11-3A-19A.4.a. d. The applicant shall obtain approval from Republic Services on the location and the design ofthe proposed trash enclosure. Contact Bob Olson at Republic Services (345-I265) for detailed review. All ofthe required changes to the plan noted above must be revised with the Building Division submittal. 4. The landscape exhibit attached as Exhibit C is approved by the City ofMeridian Planning Division on May 22,2014 with the following comments: a. Any existing landscaping near the construction zone must remain protected during construction on the site. b. Upon installation ofthe landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate ofcompletion as set forth in UDC l1-3B-14A. 5. The elevations prepared by Consulting Structural Engineers, dated May 12, 2014, labeled ,{3, is approved by the City of Meridian Planning Division on May 22,2014 with no changes. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 8. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance ofthe building permit. 9. The applicant shall complete all required improvements prior to issuance of a Certificate ofOccupancy. It is unlawful to use or occupy any building or structure until the Building Oflicial has issued a Certificate ofOccupancy. 0ngoing Conditions of Approval l. The applicant and/or assigns shall have the continuing obligation to provide inigation that meets the standards as set forth in UDC 1l-38-6 and to install and maintain all landscaping as set forth in UDC l1-38-5, UDC 11-3B-13 and UDC l1-3B-14. 2. The project is subject to all current City ofMeridian ordinances and previous conditions ofapproval associated with this site (AZ-05-010; PP-05-012; cUP-05-014; FP-05-048). 3. The issuance ofthis CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidevialk surface to afford greater Conditions Document 2 Willamette D€ntal Building - CZC-14-033 and DES-14-034 visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 1l-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC I l-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director All requests for review shall be filed in writing with the Planning Division on or before June 6, 2014,within fifteen (15) days after the written decision is issued, and contain the information listed in UDC I l-5,4-68. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of ZoningCompliance.
