DESCRIPTION OF APPLICANT'S REQUEST
The applicant requests certificate of zoning compliance (CZC) and administrative design review (DES)
approval to place a 504 square foot temporary sales office and improve the existing grivel vehicle display
area that fronts on overland Road. The site improvements include a new segment Iipaving and
perimeter
landscaping.
The site is 1.80 acres in size, zoned C-G (General Retail and Service Commercial District).

ll'28-2, vehicle sales is a principally permitted use in the C-G zone subject to specific use
standards.
The subject property is located at250 E. Overland Road.
DECISION
The applicant's request for CZC and DES is approved with the conditions listed in this report.

Site Specific Conditions of Approval
l. The site plan prepared by Quadrant Consulting, dated
l2llzllz,labeled Sheet l, is approved
(stamped "approved" on l2l20l12 by the City of Meridian Planning Division) with ttre following
comments:
o The unimproved area adjacent to the back edge of the new pavement is not approved for
vehicle display or vehicle parking and shall not be used as such.
o The applicant shall obtain approval of the stamped civil drawings detailing the drainage
of the display area from the Public Works Department.
2. The landscape plan prepared by Jensen Belts, dated lol0Sll2,labeled Sheet L.0, is approved
(stamped "approved" on l0l09l12 by the City of Meridian Planning Division) with the following
comment:
. All existing landscaping adjacent to the construction zone must remain protected during
construction on the site.
o Protect any existing trees on the subject property that are greater than four-inch caliper
and/or mitigate for the loss of such trees as set forth in UDC I I -3B-10.

o Vehicle display is prohibited in the required landscape
buffers in accord with IIDC I I -
3B_7C.6.
3' The site plan, landscape plan and building elevations shall not be altered without prior
written
approval by the city of Meridian community Development Department.
4' The building elevations prepared by LKV Architects, attached as Exhibit D are approved
(stamped "approved" on l2l20ll2 by the City of Meridian Planning Department;
with tne
following comments:
o The temporary sales office may be placed on the site in conjunction with the construction
of a permanent sales office building for a maximum period of l8 months from the
date of
issuance of the certificate of occupancy. Upon the termination of the l8 month period
or
the completion of the permanent structure,lhe temporary sales office shall
be removed
from the property.
' The applicant must obtain CZC and,DES approval from the Planning Division for the
permanent sales office building. The new building must comply with design standards
set
forth in UDC I l-3A-19 and the guidelines contained in the Meridian Design Manual.
5' Upon installation of the landscaping and prior to inspection by the
planning Division, the
applicant shall provide a written certificate of compGtion as set forth in UDC l1-3B-144.
Process Conditions of Approval
1' No signs are approved with this application. Prior to installing any signs on
the property, the
applicant shall submit a sign permit application consistent with the standards
in urjc bnapier :
Article D and receive approval for such signs.
2' The applicant shall complete all improvements related to public life,
safety, and health as set forth
in UDC 1l-5C-3B' A surety agreement may be accepted ior other improvements
in accord with
IIDC I l_5C_3C.
3' The applicant shall complete all required improvements prior to issuance of
a Certificate of
occupancy. It is unlawful to use or occupy any building or structure until the Building official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1' The applicant and/or assigns shall have the continuing obligation to provide irrigation
that meets
the standards as set forth in tlDC l1-38-6 and to install and maintain all landscaping as set forth
in UDC I l-3B-5, UDC t t-38-13 and UDC il-3B_14.
2. The project is subject to all current City of Meridian ordinances and any applicable conditions of
approval associated with this site.
3. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site (MCU-12-006).
4- The applicant and/or property owner shall have an ongoing obligation to prune all
trees to a
minimum height of six feet above the ground or sidewalk srr.fu"e to afford greater visibility of the
area.
5. The applicant shall comply with the outdoor lighting provisions as set forth in IIDC l l-3A-11.

6' The applicant and/or property owner.shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangie consistent with the standards in UDC 1l-
3A_3B.
7 ' The applicant and/or assigns shall have the continuing obligation to meet the specihc
use
standards for the approved vehicle sales use as set forth in UDC I l-4-3-3g.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision
of the Director. All
requests for review shall be filed in writing with the Planning Department on or before
January 5,2013,
within fifteen (15) days after the written decision is issued, arid contain the information listed
in UDC I 1-
54.-68.
If City Council review of the decision is not requested, the action of the Director
represents a final
decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho
Code 67-8003.
EXPIRATION
Certificates of zoning Compliance issued in conjunction with a proposed
use shall expire if said use has
not commenced within one year of the date of issuance of the Cirtifi
cate of Zoning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration
of a structure
shall expire if said construction or alteration has not commenced within one
year of the date of issuance
of the Certifi cate of Zoning Compliance.
ln accord with the above provisions, the subject Certificate of zoningCompliance
is valid until December
20,2013.
