The findings will be on the agenda for November 4th. They have 15 days from that date to submit an application
and fees ($692) for a Council Review of the Planning and Zoning Commission decision.
FYI:
Re-vamping the wireless communication section is on our list of things to do. So, after the hearing last night I
asked the applicant to provide some information that might useful in the code re-writes. As a start, he sent me this
e-mail last night. I'll let Bill make the legal call, but I'm nol sure they could have denied it based on safety.

l've been doing some homework into the questions that were brought up tonight. euestion l'm sure that
Planning Commission would like information on. First and foremost, here is a section (l bolded the most
relevant item)of the Telecom Act of 1996, which acts like the Bible to all providers (cell phone companies,
satellites, AM, FM, TV, fire/police, etc.):
RELEVANT TEXT OF SECTION 704 OF THE TELECOMMUNICATIONS ACT OF 1996 (5.652):
SEC.704. FACILITIES SITING; RADIO FREQUENCY EMISSION STANDARDS.
(a) NATIONAL wIRELESS TELECOMMUNICATIONS StTtNG POLTCY-
Section 332(c) (47 U.S.C. 332(c)) is amended by adding at the end the following new paragraph:

(7) PRESERVATTON OF LOCAL ZONTNG AUTHORTTY-
(A) GENERAL AUTHORITY- Except as provided in this paragraph, nothing in this Act shall limit or affect the
authority of a State or local government or instrumentality thereof over decisions regarding the placement,
construction, and modification of personal wireless service facilities.
(B) LTMTTAT|ONS-
(i) The regulation of the placement, construction, and modification of personal wireless service facilities by any
State or local government or instrumentality thereof-
(I) shall not unreasonably discriminate among providers of functionally equivalent services; and
(II) shall not prohibit or have the effect of prohibiting the provision of personal wireless services.
(ii) A State or local government or instrumentality thereof shall act on any request for authorization
to place, construct, or modify personal wireless service facilities within a reasonable period of time
after the request is duly filed with such government or instrumentality, taking into account the
nature and scope of such request.
(iii) Any decision by a State or local government or instrumentality thereof to deny a request to place, construct,
or modifu personal wireless service facilities shall be in writing and supported by substantial evidence
contained in a written record.
(iv) No State or local government or instrumentality thereof may regulate the placement,
construction, and modification of personal wireless service facilities on the basis of the
environmental effects of radio frequency emissions to the extent that such facilities comply with
the Commission's regulataons concerning such emissions.
As it states, the FCC regulates the emissions of the RF energy and so long as the providers can prove to the
FCC
that they are operating within those guidelines, jurisdictions cannot deny the use.
I will get more information on how often studies are done. lt's my understanding that any time a change is
made to a site (want to increase the power, change the antennas, add antennas, etc., it must
be proven to the
FCC that the use is still in compliance.

ln reference to your question if a neighborhood meeting was held... .yes, on 6115110 (application was submitted on
7128); two people attended (Dan Reid & Carla Ode).
The three folks (Sue Darden, Matthew Harrison, & Terri Kilroy) that signed in as "opposed" at the hearing were
not in attendance at the neighborhood meeting.
Of those three, Darden & Harrison werewithin 300'of the property & were notified of the public hearing; Kilroy is
approximately 1,700 ft away on the south side of Pine & was not notified.

I understand that you were told by Anna that you did not have to submit all of
the documentation required by UDC
1 1-4-3-43 for the proposed wireless communication facility at this time with the CUP application. I .iust wanted to let
you know that you will be required to submit any additional documentation required by UDC 11-4-3-43 at the time
of CZC application. ln accord with currenl UDC requirements, the following additional items will need to be
submitted: (if an amendment to this section of code is approved by Council prior to submittal of the CZC
application, you will be required to comply with the code in effect at the time of application submiftal)
> (11-4-3-43D. 1) Documentation from a qualified and licensed engineer showing that the
proposed facility will be in
compliance with the FCC standards regarding radio frequency (RF) emissions. The letter submttted by KC Gibson only
states that Verizon will ensure that all FCC standards & requirements are met; the engineer needs to evaluale the
proposal & state if it does or does not comply.
> (11-4-3-430. 2) A report from a qualified and licensed structural engineer that describes the tower height and design.
The report shall include the following: a cross section of the tower, elevations that document the height above grade
for all potential mounting positions for collocated antennas, and the minimum separation distances between antennas.
The report must also include a description of the towe/s capacity regarding the number and type of antennas that it
can accommodate and what precautions the applicant will take to avoid interference with established public safety
telecommunicalions. This report must be stamped by the structural engineer and include other information necessary
> to (11-evaluate 4-3-430.the 3) request.For allwireless communication facilities, a letter of intent committing the tower owner and his, herorits
successors to allow the shared use of the tower, as required by this section, if an additional user agrees in writing to
> meet (11-4-reasonable 3-43D.4)A terms statement and conditions regarding compliance for shared use. with Submit regulatrons a letter administered from the school and enforced distict.by
the federal aviation
> administration (11-4-3-43D.6) (FAA)A written . analysis demonstrating that the proposed site is the most appropriate site within the
immediate area. The analysis shall include, but is not limited to, the following:
a. Description of the surrounding area, including topography;
b. Natural and manmade impediments, if any, that would obstruct adequate wireless telephone transmissions;
c. Physical site constraints, if any, that would preclude construction of a wireless communications facility on any other
site;
d. Technical limitations of the system that limit siting options. (Ord. 05-1170, 8-30-2005, eff. 9-15-2005)
> (114-3-43E) Antenna Standards Within Residential Districts: The following standards shall apply to all wireless
communication facilities within residential districts except those that qualify as amateur radio antennas as set forth in
subsection C ofthis secUon:

d. The planned equipment would cause interference, materially impacting the usability of other existing or planned
equipment on the tower as documented by a qualified and licensed engineer.
e. Existing or approved towers cannot accommodate the planned equipment at a height necessary to
function
reasonably as documented by a qualified and licensed engineer.
You noted in your nanative that you're requesting a variance for the height of the tower. Per UDC 1'l-2A-3E.2,
the maximum
height limitations shall not apply to wireless communication facilities or other appurtenances not intended for human
occupancy. Therefore, a variance rs not necessary.
I do need you to submit a full.size set of plans that are 3calable asap.
