The property is located at 800 E. Pine Avenue, between N. Stonehenge Way and E. 5th Street with connection to Five Mile Creek Pathway. Avebury Subdivision has 14 buildable lots and 3 common lots on 3.0 acres and is zoned R-15. Currently, the Final Plat has been signed by the Central District Health Department and the Ada County Highway District pending conditions of approval for a stormwater swale located along the east property line in lot 16. The developer has completed 95% of the construction activities with the exception of the stormwater swale. All utility services and site lighting have been installed and paved over as of spring of 2018. BACKGROUND In the beginning of 2016, the development team's goal was to have Avebury Subdivision constructed by spring of 2017. Contractors had prepared the site for construction and upon installing the monitoring well for the development, high ground water was found to be inconsistent with the Geotechnical report that was provided. Bob Arnold was hired to complete the original Geotechnical report to monitor test pits to determine high groundwater. The reports were not distributed in a timely manner, delaying the initial construction timeline. Reports were requested in January of 2017 and were not received until nearly 4 months later, in May of 2017. This discovery initiated a plan change for site drainage to remove the seepage beds and to construct a stormwater swale. The swale was to be designed following ACHD Wet Pond standards and was to accompany a report from Bob Arnold verifying percolation rates following the high groundwater findings. The report was not provided until 3 months after plans had been revised. The revision was approved by the City of Meridian on April 18, 2017, and construction was anticipated to start during late summer of 2017 and to be completed by early fall. A preconstruction meeting was held in August of 2017 and where contracts were signed with Cherrod Development. Cherrod Development was unable to start construction and meet deadlines due to failing out between Cherrod Development and a subcontractor, resulting in the termination of their contract. New contractors were hired and construction restarted in November of 2017. Construction was nearly complete when ACHD reported another issue with the stormwater swale constructed along the east property line. Except for the ACHD stormwater swale, all construction including landscape was completed in June of 2018. Along with these review mishaps, a time extension was not submitted to continue the project. Due to this error, the project has expired, and a continuation is requested. Utilities have been installed and tested by Dave Clifford of Hi -Grade Underground, Inc. Ph:308-888-6241 davec@higrade.us The subdivision design has been reviewed by Mike Alexander at Ada County Highway District for the 9th time to ensure that the revised stormwater swale located in lot 16 will be adequate to support stormwater overflow. For this revision to be approved, lots 14 and 15 have been modified to allow for increased surface area in lot 16 to accommodate the high groundwater found during construction. This would require the units on lots 14 and 15 to become attached, which is not allowed based on the current development agreement. Due to these revisions, we are requesting both a final plat modification and a development agreement modification to accommodate the lot line and easement revisions required by ACHD to approve the stormwater swale. OBJECTIVE Our objective for Avebury Subdivision is to complete construction per the approved plans signed by the Ada County Highway District so that we can complete the subdivision process per City of Meridian standards. Therefore, we would appreciate the City Council's approval of a six-month time extension, as well as the final plat and development agreement modifications. If approval for this request is not granted, the City would have to return the existing letter of credit and we would be required to submit the same plat, as well as obtain the same approvals for the existing construction improvements that are installed. We plan to complete the project no later than April of 2018. Therefore, we request your approval of this application. The intent of the final plat and development agreement modification are to revise lot lines, setback distances and building type restrictions due to the changes required by Ada County Highway District. The development agreement will allow for setbacks along eastern property lines to be 3' in width and will also allow attached units to be developed on lots 14 and 15 where a zero lot line exists. These revisions are based on the width increase of lot 16 required by ACHD for increased surface area at the storm water swale, accommodating the high ground water that was found during construction.
