At the hearing, the City Council voted to approve the Applicant's request for a modification to the existing development agreement (DA), as proposed, with one change. Because Staff recommended denial of the application to City Council, no Staff recommended provisions or changes to the proposed provisions were included in the staff report. It was suggested that the application should be continued in order to allow Staff time to prepare a recommendation for Council's consideration that might include additional DA provisions and/or for modifications to the amended DA provisions proposed by the Applicant. Although Council did not vote to continue the application, Staff has prepared a recommendation for Council's review prior to approval of the Findings, attached to this memo entitled "Exhibit B". The provisions recommended by Staff are based on discussion and testimony provided at the public hearing related to Meridian City Code and Unified Development Code standards for Heavy Industry and Recycling Center & Solid Waste Transfer Station uses. If Council wishes to discuss the inclusion of Staff's recommended provisions, this item may need to be continued to a later date for discussion so that the public can be made aware of the additional consideration.
