APPLICATION SUMMARY The applicant, neUdesign Architecture, requests approval to vacate an existing 20’ x 20’ water easement located near the northeast corner and a 14’ x 13’ portion of an existing wat er easement located in the southwest corner of Lot 11, Block 2, Gramercy Subdivision No. 1. 2. STAFF RECOMMENDATION Staff recommends approval of the subject vacation application. 3. Applicant's Statement/Justification: Please see applicant’s narrative for this information and the application file for the applicable relinquishment approvals. 5. PROCESS FACTS A. The subject application is a request to vacate certain platted water easements on Lot 11, Block 2, Gramercy Subdivision No. 1. Per Unified Development Code Table 11-5A-2, the Director is the decision making body on vacation applications such as this that are exempt per Idaho §50- 1306A(5). However, it’s been previous policy that City Council approves these requests at a public meeting. 6. LAND USE A. Existing Land Use(s): The easements proposed to be vacated lie on one commercial building lot (Lot 11, Block 2), zoned C-G. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrounding area is currently in the development process as a commercial subdivision, zoned C-G. C. History of Previous Actions:  In 2017, a final plat depicting the portion of the easement proposed to be vacated was recorded (Bk. 99, Pg. 12619).  On April 9, 2018, a property boundary adjustment application was tentatively approved (A- 2018-0127); see Record of Survey in Exhibit A.2. Several items were required to be completed prior to final approval; these have not yet been completed.  On August 21, 2018, a Certificate of Zoning Compliance and Design Review application was approved for a 10,400 square foot office building on this site. A condition of approval required the applicant to obtain approval of the subject vacation of water easements on this site prior to issuance of Certificate of Occupancy. 7. STAFF ANALYSIS The applicant requests approval to vacate an existing 20’ x 20’ water easement located near the northeast corner and a 14’ x 13’ portion of an existing water easement located in the southwest corner of Lot 11, Block 2, Gramercy Subdivision No. 1 (see legal descriptions and exhibit maps in Exhibit A.3). The easement at the northeast corner of the site contains an existing water line that is proposed to be abandoned and the easement vacated. A portion of the easement at the southwest corner of the site is proposed to be vacated to reduce the size of the easement; this line will service the property but will be shortened to allow for more space on site for the building and parking lot. The remaining portion of the easement is sufficient size to accommodate the water service for the building.
