RE: 1378, 1400, and 1418 N. Oak Creek Way Rear Fencing (A-2018-0170)
Dear Mr. and Mrs. Altman
This letter is in response to your request for alternative compliance (ALT) to UDC 11-3A-7, to
allow for an eight foot (8') fence along the rear lot line of three properties located in Rods
Parkside Creek Subdivision.
UDC 11 -3A -7C states that maximum fence height shall not exceed six feet (6'). The properties
in question have requested permission to install an 8' fence to screen views and noise from the
Albertsons grocery store complex at 3301 W. Cherry Ln. Alternative compliance has also been
requested to increase security and privacy due to an elevated pathway along the rear lot lines of
the subject properties.
This request for alternative compliance applies to the following subject properties:
1418 N. Oak Creels Way; Lot 17, Block 13 of Rods Parkside Creek Subdivision No. 4;
current owners Timothy and Leah Larsen; 112 feet of rear lot line.
1400 N. Oak Creels Way; Lot 18, Block 13 of Rods Parkside Creek Subdivision No. 4;
current owner Altman DD Family Trust; 135 feet of rear lot line.
1378 N. Oak Creek Way; Lot 19, Block 13 of Rods Parkside Creek Subdivision No. 4;
current owners Albert and Patricia Stewart; 83 feet of rear lot line.
This letter is to confirm the Director approved your request for alternative compliance to Unified
Development Code (UDC) 11-3A-7, fence requirements, for the subject property based on the
required Findings listed in UDC 11-513-5E, as follows:
1. Strict adherence or application of the requirements are not feasible; or
Staff finds that strict adherence to the requirements of UDC 11-3A-7 is not feasible
due to a change in topography of the pathway along the rear of the subject properties
along Eightmile Lateral irrigation easement. According to the application narrative,
the pathway along the lateral has been raised 8-12 " over time, resulting in an

elevated platform for traffic passing by the rear lot lines of the subject properties.
Alternative compliance will provide more security for the subject properties.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
The proposed 8' fencing shall match existing 8' fencing installed for four residences
located to the northwest of the subject properties along the Eightmile Lateral. The
proposed fencing will provide increased privacy and security to the subject properties
and will be consistent with fencing installed along the northwest section of the lateral.
3. The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of surrounding properties.
As the pathway along the lateral is visible from Ten Mile Rd. and the Albertson
parking lot the proposed fencing will not create an enclosed or private space within
the easement. The alternative means will not be detrimental to the public welfare or
impair the use or character of surrounding properties.
The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before June 14, 2018, within fifteen (15) days after
the written decision is issued, and contain the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
