We have reviewed staff comments for the Planning & Zoning Commission meeting of
August 16, 2018, and have the following responses:
EXHIBIT B - AGENCY & DEPARTMENT COMMENTS/CONDITIONS
1. PLANNING DIVISION
1.1 Site Specific Conditions of Approval
1.1.1 Understood.
a. Prior to the Planning and Zoning Commission hearing, the applicant has revised the
plat in the following ways:
• A 15 -foot -wide micro -path was added in Block 6 providing linkage to Cobblefield
Subdivision. It is difficult to deal with other neighborhood associations;
therefore, we object to coordinating with an unrelated, developed subdivision for
off-site improvements.
• We object to eliminating the McMillan Road public street access. In meetings
with the adjoining residents, they did not want all traffic to funnel through their
neighborhoods and were supportive of the independent access. We met with
Christie Little and Mindy Wallace at ACHD, and the District approves of the
access to McMillan Road.
• In discussions with ACHD, we have agreed to provide traffic -calming along Loretta
Street with a raised pedestrian crossing and stop control at Bird Wing and Bryce
Canyon. The preliminary plat has been modified to reflect the traffic calming.
• Lot 10, Block 1 has been modified to be a minimum of 8,000 square feet in accord with
UDC 11-2A-5.

1.1.2 The preliminary plat included in Exhibit A.2, dated 5/23/2018, was revised as follows:
a. Understood.
b. The applicant will comply.
c. The 60 -foot -wide Idaho Power easement and 50 -foot -wide Lemp Canal easement have
been delineated on the preliminary plat.
d. Lot 10, Block 1 has been modified to meet the minimum lot size requirements.
1.1.3 The landscape plan included in Exhibit A.3, dated 5/14/2018, has been revised as follows:
a. Trees along the McMillan frontage will be restricted to Class 1 due to the overhead
transmission lines. Grass or gravel on the north side of the Lemp Canal will not be
allowed as requested by staff, as there is insufficient room and that is the
maintenance side of the canal. No curb or gutter proposed for McMillan Road, so
the condition 1.1.3a is not applicable.
b. The applicant's representative at Jensen -Belts has contacted Elroy Huff, and the applicant
will comply.
c. The applicant has complied.
d. Grass or gravel on the north side of the Lemp Canal will not be allowed as
requested by staff, as there is insufficient room and that is the maintenance side of
the canal.
e. The applicant will comply.
f. It is not possible to receive approval from agencies prior to submittal of
construction plans, which are submitted with the final plat. We have contacted
Idaho Power Company and the Settlers Irrigation District to discuss the project,
and they both have indicated their preliminary approval of the landscape concept
and improvements and willingness to work with us.
g. We have had multiple discussions with Mack Meyers at Settler Irrigation
District. The District maintains the waterway from McMillan Road and has
allowed other developments along the corridor to install turf up to the south side
of the bank with a license agreement.
1.1.4 The applicant will comply.
1.2 General Conditions of Approval
1.2.1 The applicant will comply.
1.2.2 The applicant is requesting a waiver to allow access to McMillan, as the property has
one-quarter mile of frontage and it is undesirable to route trips from 128 homes
through existing subdivisions. ACHD has reviewed the Traffic Impact Study and
prepared a staff report allowing for the street approach to McMillan Road.
1.2.3 Understood, with the exception that the Lemp Canal will remain open.
