Hi Sonya – The ITD catch slope information was added to the revised preliminary plat that was
submitted to the City prior to the City Council hearing (See attached). The McMillan Rd. 25-foot
landscape buffer is outside of, and does not encroach on the catch slope area.

Preliminary Plat site specific condition #1.2.1a requires, “Depict the location of the toe of the
slope/future right-of-way for the future overpass on W. McMillan Road. The common lot for the
street buffer needs to be outside of this area.” It appears the toe of slope encroaches within
adjacent building lots, is that the case?
