BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL. OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: WHEREAS, the City of Meridian, Ada County, Idaho, has deter- mined that there is a severe shgrtage of municipal recreation facilities for the residents of said City, and WHEREAS, the City wishes to improve the recreation facilities and environmental quality of the City and surrounding area, WHEREAS,, the Western ,Ada Recreation District is a political subdivision of the State of Idaho, including within its bounda- ries the City of Meridian and adjacent territories, and is now planning to construct a swimming pool and other recreational' facilities within the limits of the City of Meridian, and WHEREAS, the proposed location of such swimming pobl wil require an easement for ingress and egress and for water axid sewer line's over property owned by the City, and a long-term 1gase of a small portion of property owned by the City. NOW, THEREFORE, be it resolved by the City of Mer�diAn, Ada County, Idaho, that Don M. Storey, Mayor and Harold Cox, City Clerks be empowered to execute a Grant of Easement to said District, a copy of which is attached hereto and marked Exhibit 11111, and further empowered to execute a Lease with said District, a copy of which is attached hereto and marked Exhibit "2", and further empowered to execute a easement for a water main and a sewer line, a copy of which is attached hereto and marked Exhibit "3". It is our understanding that the developer's of subdivisions which have not previously been reviewed and approved by the City of Meridian are required to sign a commitment by approximately July 1, 1972, agreeing to make an advance payment to the City of Meridian of $100 for each conventional -home lot and $50 for each mobile -home lot upon demand by the City prior to the City permitting any new development. We further understand that as the Gregory Subdivision Unit No. 3 was previously approved on a tentative basis, we will not be required to make an advance payment btit rather will pay the said addi- tional $100 per lot payment at the time the water service is actually requested for an individual lot within our subdivision. We understand that this said $100 per lot payment will be in addition to the present water meter installation and hookup charge and the present sewer hookup charge. It is also our understanding that a comprehensive engineering study of water and sewer needs for the City of Meridian is to be made and that upon completion of said study, the $100 per lot payment might be modified. We hereby agree to comply with the said $100 per lot payment or the modified payment to be determined upon completion of the engineering study as outlined hereinabove. We hope that this letter of commitment will fulfill your requirements so that we can proceed with the development of Gregory Subdivision Unit No. 3.
