CZC Application
Joseph Buchinskiy of AAA Vacuum & Sewing has purchased the building at 412 E. Fairview. The
existing building was formerly a convenience store and gas station. The gas pumps and cover
for the pumping area have been removed. Mr. Buchinskiy would like to open a shop to repair
and sell vacuums and sewing machines. He currently owns a shop in California that is similar.
The bathroom will be upgraded to ADA compliance. The counter will be modified to be ADA
compliant. No exterior building improvements will be done. Existing parking spaces will be
repainted. Some existing parking will be removed and relocated to facilitate the new landscape
buffer. A six foot landscape buffer and a five foot detached sidewalk will be added to Fairview
Ave at 62' from the centerline of Fairview to maintain the easement for Fairview. Trees and
bushes will be added to the landscape buffer. A alternative compliance application for a reduction
of the landscape buffer will accompany this application.

Alternative Compliance Application
Joseph Buchinskiy of AAA Vacuum & Sewing has purchased the building at 412 E. Fairview. The
existing building was formerly a convenience store and gas station. The gas pumps and cover
for the pumping area have been removed. Mr. Buchinskiy would like to open a shop to repair
and sell vacuums and sewing machines. He currently owns a shop in California that is similar.
We request a reduction of the 25' landscape buffer to a 11' landscape buffer due to the site
constraints of the existing building. A 25' landscape buffer would greatly reduce the parking area
and inhibit connectivity with the sites to the east and the west. Pedestrians would be required
to jog significantly to the north to access the sidewalk.
Some existing parking will be removed to facilitate the new landscape buffer. A six foot landscape
buffer and a five foot detached sidewalk will be added to Fairview Ave at 49' from the centerline
of Fairview to maintain the easement for Fairview. This 11' buffer request was recommended by
Austin at ACHD. Trees and bushes will be added to the landscape buffer. A CZC application will
accompany this request.

Joseph Buchinskiy and Ruslana Buchinskaya, husband and wife, ("Grantee"), whose address is 551

described real property situated in Ada County, State of Idaho:

SUBJECT TO taxes and assessments for the year 2017 and all subsequent years, together
with any and all existing easements, rights-of-way, reservations, restrictions and
encumbrances of record, to any existing tenancies, to all zoning laws and ordinances, and

RESTRICTIVE COVENANT: Grantee agrees on behalf of itself, its heirs, successors, and assigns, that
from and after the date of this conveyance, the real property described herein (the "Property") shall not
be used as a gas station, convenience store, or for the sale of tobacco and/or vaping products, and
packaged beer and wine. Notwithstanding the foregoing, the Property may be used as a restaurant serving
food, beer, wine, and spirits for consumption on the premises. Grantee agrees that this restriction shall
be a covenant running with the land and shall be contained in and made a part of every deed, mortgage,
lease, or other instrument affecting title to the real property conveyed by this deed.
