EASEMENT
This Easement is granted by James A. Kissler LLC, an Idaho limited liability company
("Grantor"), to and for the benefit of Roger L. Anderson and Susan Anderson, husband and wife
(jointly "Grantee"), to be appurtenant to the land owned by Grantee (PAR #6490 @ S SIDE
SE4SW4 of SEC 16 3N 1 E, #33652013) adjoining the Easement Area (defined below).
RECITALS:
WHEREAS, Grantor is the owner of land described on Exhibit A attached hereto; and
WHEREAS, in order to satisfy the requirements of the City of Meridian for the issuance
to Grantor of a certificate of zoning compliance, Grantor desires to grant Grantee an easement
over that portion of Grantor's property depicted on Exhibit B attached hereto (the "Easement
Area").
NOW, THEREFORE, for good and valuable consideration, the sufficiency of such is
acknowledged by Grantor, Grantor hereby grants to Grantee an easement over and across the
Easement Area for the following purposes and subject to the following terms:
A. Grantee, together with Grantee's invitees, customers, delivery trucks, contractors,
sub -contractors, inspectors, and other entities associated with the construction and
operation of any future development contemplated on Grantee's appurtenant land,
may use the Easement Area for vehicular and pedestrian access to and from
Grantee's appurtenant land;
B. The Easement Area shall be surveyed by Grantor's certified surveyor with a
record of survey recorded in Ada County, Idaho, upon which recordation by the
Ada County Recorder an amendment to this Easement shall be prepared by
Grantor, and recorded by the Ada County Recorder, definitively defining the
boundaries of the Easement Area; and
C. The easement hereby granted shall run with the land and be binding on Grantor's
successors and assigns and all persons claiming under them.
