Schaffer, the parties of the first part, and hereinafter called the Grantors. and the City of Meridian, Ada County, Idaho, the party of the second part, and hereinafter called the Grantee; WITNESSETH: WHEREAS, the Grantors desire to provide a sanitary sewer and water main right-of-way across the premises and property hereinafter particularly bounded and described; and WHEREAS, the sanitary sewer and water is to be provided for through underground pipelines to be constructed by others; and WHEREAS. it will be necessary to maintain and service said pipelines trom time to time by the Grantee; NOW, THEREFORE, in consideration of the benefits to be received by the Grantors. and other good and valuable consideration, the Grantors do hereby give. grant and convey unto the Grantee the right-of-way for an easement for the operation and maintenance of sanitary sewer and water mains over and across the following described property: A temporary sewer and water easement located in the SW Y. of Section 20, Township 3 North, Range 1 East, Boise Meridian, Meridian, Ada County, Idaho, more particularly described as follows: An easement for sanitary sewer and water main, located in the SW 1/4 of Section 20, Township 3 North, Range 1 East, Boise Meridian, Meridian, Ada County, Idaho, being a strip of land 50,00 feet in width, 25.00 feet on either side of the following described centerline: Commencing at the SW corner of Section 20, T.3N., R.1E., B.M., thence N 00°44'50" E 1133.09 feet along the westerly boundary line of said Section 20 to the REAL POINT OF BEGINNING of this centerline description; Thence S 89°15'10" E 135.92 feet to a point of curvature; Thence along a curve to the left 82.89 feet, said curve having a radius of 200.00 feet, a central angle of 23°44'50", tangents of 42.05 feet, and a chord of 82.30 feet which bears N 78°52'25" E to a point of tangency; Thence N 6rOO'OO" E 61.53 feet to a point of curvature; Thence along a curve to the right 60.21 feet, said curve having a radius of 150.00 feet, a central angle of 23°00'00", tangents of 30.52 feet, and a chord of 59.81 feet which bears N 78°30'00" E to a point of tangency; Thence S 90°00'00" E 115,64 feet to a point of curvature; Thence along a curve to the right 20.94 feet, said curve having a radius of 300.00 feet, a central angle of 04°00'00", tangents of 10.48 feet, and a chord of 20.94 feet which bears S 88°00'00" E to a point of tangency; 961102\sanitarysewer&water-eas Thence S 86°00'00" E 70.59 feet to a point; Thence S 04°00'00" W 168.47 feet to a point of curvature; Thence along a curve to the left 92.12 feet, said curve having a radius of 65.00 feet, a central angle of 81°11'52", tangents of 55.71 feet, and a chord of 84.60 feet which bears S 36°35'56" E to a point of tangency; Thence S 77"11 '52" E 62.99 feet to the ENDING POINT of this centerline description. Also see attached Exhibit #A The easements hereby granted are for the purpose of construction and operation of sanitary sewer and water mains and their allied facilities, together with their maintenance, repair and replacement at the convenience of the Grantee, with the free right of access to such facilities at any and all times. TO HAVE AND TO HOLD, the said easement and right-of-way unto the said Grantee, it's successors and assigns forever. IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto, that the Grantee, in making future repairs, will expediently replace and restore the premises to a condition comparable to that existent prior to undertaking such repairs and replacement. However, the Grantee will not be responsible for repairing, replacing or restoring any permanent structures, large trees or brush placed within the area described in this easement. THE GRANTORS hereby covenant and agree that they will not place or allow to be placed any permanent structures, large trees or brush within the area described for this easement, which would interfere with the use of said easement, for the purposes stated herein. THE GRANTORS do hereby covenant with the Grantee that they are lawfully seized and possessed of the aforementioned and described tract of land, and that they have a good and lawful right to convey said easement, and that they will warrant and forever defend the title and quiet possession thereof against the lawful claims of all persons whomsoever.
