FEE DEPUTY SANITAR WATERM THIS INDENTURE, made this/7 day ofa#..etn~ ¡{j[between Martv Goldsmith and Farwest Development L.L.C. , the parties of the first part, and hereinafter called the Grantors, and the City of Meridian, Ada County, Idaho, the party of the second part, and hereinafter called the Grantee; WITNESSETH: WHEREAS, the Grantors desire to provide a sanitary sewer line and water main right-of-way across the premises and property hereinafter particularly bounded and described; and WHEREAS, the sanitary sewer line and water main is to be provided through underground pipelines to be constructed by others; and WHEREAS, it will be necessary to maintain and service said pipelines from time to time by the Grantee; NOW, THEREFORE, in consideration of the benefits to be received by the Grantors, and other good and valuable consideration, the Grantors do hereby give, grant and convey unto the Grantee the right -of-way for an easement for the operation and maintenance of sanitary sewer line and water main over and across the following described property: A temporary sewer and water easement located in the SE Y. of Section 20. Township 3 North. Range 1 East, Boise Meridian, Meridian, Ada County, Idaho, more particularly described as follows and as shown on Exhibit "A": Easement for sanitary sewer and water main, located in the SW 1/4 of Section 20, Township 3 North, Range 1 East, Boise Meridian, Meridian, Ada County, Idaho, being a strip of land 35.00 feet in width, located as described below on either side of the following described centerline: Line "A" Commencing at the center Y. corner of Section 20, T.3N., R.1 E., B.M., thence S 0°23'51" W 331.44 feet along the westerly boundary of the SE Y. said Section 20 to the BEGINNING POINT of this centerline description of Line "A"; Easement is 10.00 feet right and 25.00 feet ieft: Thence S 89°36'09" E 71.90 feet to an angle point; Thence S 51°00'00" E 548.76 feet to an angle point; Thence N 41 °12'35" E 198.98 feet to an angle point; Thence S 86°00'00" E 597.07 feet to the beginning point of Line "B" as described below; Thence S 86°00'0" E 472.57 feet to a point on the westerly boundary of Thousand Springs Subdivision No.1, the END POINT of Line "A". 9611O2\sanitarysewer-eas ., Line "B" Commencing at the center Y. corner of Section 20, T.3N., R.1 E., B.M., thence S 0"23'51" W 560.74 feet aiong the westerly boundary of the SE Y. of said Section 20; Thence S 89"36'09" E 1226.71 feet to the beginning point of this centerline description of Line "B"; Easement is 25.00 feet right and 1 0.00 feet left: Thence N 4"00'00' E 278.50 feet to an angle point; Easement is 10.00 feet right and 25.00 left: Thence S 86"00'00" E 472.57 feet to a point on the westerly boundary of Thousand Springs Subdivision No.1, the END POINT of Line "B". The easements hereby granted are for the purpose of construction and operation of sanitary sewer lines and water main and their allied facilities, together with their maintenance, repair and replacement at the convenience of the Grantee, with the free right of access to such facilities at any and all times. TO HAVE AND TO HOLD, the said easement and right-of-way unto the said Grantee, it's successors and assigns forever. IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto, that the Grantee, in making future repairs, will expediently replace and restore the premises to a condition comparable to that existent prior to undertaking such repairs and replacement. However, the Grantee will not be responsible for repairing, replacing or restoring any pennanent structures, large trees or brush placed within the area described in this easement. THE GRANTORS hereby covenant and agree that they will not place or allow to be placed any pennanent structures, large trees or brush within the area described for this easement, which would interfere with the use of said easement, for the purposes stated herein. THE GRANTORS do hereby covenant with the Grantee that they are lawfully seized and possessed of the aforementioned and described tract of land, and that they have a good and lawful right to convey said easement, and that they will warrant and forever defend the title and quiet possession thereof against the lawful claims of all persons whomsoever. That said easement shall be discontinued and ordinary use shall revert back to the underlying owner, in the event that the described property is properly constructed and completed in accordance with Ada County Highway District's Standard Specifications and accepted as a public street through recordation of a final plat. 9611O2\sanitarysewer-eas ,.
