Osterhues Utility EasementUTILITY EASEMENT Roger P. and Lynn Osterhues , Grantor of Ada County, State of Idaho do hereby grant and convey to the CITY OF MERIDIAN, a municipality, its licensees, successors and assigns, for One Dollar and other valuable considerations, receipt of which is hereby acknowledged, a permanent and perpetual easement and right of way, to install and maintain underground public utility lines, including the perpetual right to enter upon the real estate hereinafter described, at all reasonable times, to construct, maintain and repair underground utilities, over, through, under and across said lands, together with the right, at the sole expense of Grantee, to excavate and refill ditches and trenches for the location of said utilities, and the further right to remove tress, bushes, sod, flowers and shrubbery and other obstructions and improvements, interfering with the location, construction and maintenance of said utilities, over, on and across the following premises belonging to the said Grantor in Ada County, State of Idaho, in the following location, to wit: A Public utilities easement located in the NE '/4 of the SE '/4 of Section 18, "Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho, as shown in Exhibit "A", more particularly described as follows: Commencing at the northeast corner of the SE 'i4 (East %4 corner) of Section 18, T.3N., R.1 E., thence S 0°31'32" W 503.35 feet along the east line of said Section 18 to a point; Thence S 89° 11'28" W 391.46 feet along the southerly right-of-way of E. Central Drive extended to the Real Point of Beginning of this description, Thence S 89'11'28" W 22.19 feet along said southerly right-of-way to a point on the centerline of the Hunter lateral; Thence S 23'44'13" E 18.46 feet along said centerline to a point; Thence N 89°11'28" E 15.00 feet to a point; Thence N 0048'32" W 17.00 feet to the REAL POINT OF BEGINNING of this description. In exchange for granting the easement, the grantee will: Install approximately 20 LF or 12" pipe through an open ditch. Deliver and spread up to two truck loads of road mix between gravel surface on grantor's property and E. Central Drive to serve as a 12' wide driveway.
