This Acknowledgment and Acceptance of Easement Agreement is e?ffZA(gwa
day of February, 1996 by B & F Enterprises, an Idaho general partnership (he0®fUlftetT THE REQUEST OF
"B&F") for the following reasons:
A. On December 22, 1995 B&F entered into that certain Easement Agreement
by and between B&F and the City of Meridian for the benefit of the City of Meridian, and
for the benefit of B&F, which Easement Agreement was recorded on January 30, 1996 in
the official records of Ada County, Idaho as document number 96008003, which Easement
Agreement referenced certain real property as described and depicted on Exhibits A and B,
attached hereto and made a part hereof.
B. On January 23,1996, B&F executed that certain Rescission of Easement,
which Recision of Easement was recorded on January 23, 1996 in the official records of
Ada County, Idaho as document number 96005948.
C. B&F desires to clarify that it declares, acknowledges, accepts and agrees that
such Rescission of Easement is null and void and of no force and effect, and also that B&F
declares, acknowledges, accepts and agrees that the Easement Agreement is in full force
and effect.
NOW, THEREFORE, in consideration of Ten Dollars ($10.00) and other good and
valuable consideration, the receipt and sufficiency of which are hereby acknowledged, and
the recitals above which are incorporated below, B&F declares, acknowledges, accepts and
agrees as follows:
1. That certain Rescission of Easement, which Rescission of Easement was
recorded on January 23, 1996 in the official records of Ada County, Idaho as document
number 96005948 is null and void ab initio and of no force and effect.
2. That certain Easement Agreement by and between B&F and the City of
Meridian for the benefit of the City of Meridian, and for the benefit of B&F, which
Easement Agreement was recorded on January 30, 1996 in the official records of Ada
County, Idaho as document number 96008003 is in full force and effect.
In witness whereof, B&F has caused this Acknowledgment and Acceptance of
Easement Agreement to be duly executed on the date first referenced above.
