EASEMENT
GRANTOR: K2 CONSTRUCTION, INC., an Idaho corporation, 600 North Curtis, Suite
145, Boise, Idaho 83706.
GRANTEE: City of Meridian, 33 East Idaho, Meridian, Idaho 83642.
EASEMENT DESCRIPTION:
See attached Exhibit "A". Said easement is a thirty foot wide emergency access easement
to the property set forth on Exhibit "B" in favor of the City of Meridian. Such easement
shall be usable by Grantee for all such purposes, without limit, and Grantee may further
delegate the ability to use such easements to any necessary entity to further said
purposes, including, but not limited to, emergency services companies and any public
body.
FOR VALUE RECEIVED, Grantor does hereby grant, bargain, sell, and convey unto the
Grantee the above described easement; TO HAVE AND TO HOLD the said easement, with
their appurtenances unto the said Grantee, and Grantee's heirs and assigns forever.
Grantor does covenant to and with the said Grantee that Grantor is the owner in fee simple
of the said premises over which the easement runs; that said premises are free from all
encumbrances except financing encumbrances and that Grantor will warrant and defend
the same from all lawful claims whatsoever.
