Flying J Water Line EasementGRANT OF EASEMENT 13770©OGGS FOR VALUE RECEIVED, FLYING'J'. INC.. GRANTOR, hereby grants, bargains, sells, conveys, and transfers unto CITY OF MERIDIAN, IDAHO, a municipal corporation, GRANTEE, its successors and assigns, a permanent easement and right-of-way for the purpose of locating, establishing, constructing, maintaining, repairing and operating an underground water line together with the right to excavate and refill ditches and/or trenches for the location of said water line, the right to remove bushes, trees, undergrowth and other obstructions interfering with the location, construction and maintenance of said water line and the right of ingress and egress in, from, to and over said easement for the purpose of inspecting, maintaining and repairing such water line. In consideration of granting this easement and right- of-way, the GRANTOR has the right to connect to said water line when development of GRANTOR'S property occurs. The perpetual easement and right-of-way hereby given, conveyed and transferred for maintaining, repairing and operating an underground water line is described in general language as follows: Commencing at the southwest corner of Section 16, T.3 N., R.1 E., B.M., thence N 89044'26" E 180.00 feet to a point on the south line of said Section 16; Thence N 0015'34" W 25.00 feet to a point on the northerly right-of-way of Overland Road, the REAL POINT OF BEGINNING of this easement; Thence N 69029'04" W 5.00 feet along said right-of-way to a point; Thence N 50°38'41" E 5.02 feet to a point on the westerly right-of-way of Ten Mile Creek; Thence S 09013'34" E 5.00 feet to the REAL POINT OF BEGINNING of this easement. This easement contains 10.85 square feet. TO HAVE AND TO HOLD the said perpetual easement, right, and rights-of-way to City of Meridian, Idaho, its successors and assigns forever, except the GRANTOR reserves the right to occupy, use and cultivate the surface of said easement for all purposes not inconsistent with the rights herein granted. Further, the GRANTEE agrees and covenants with the GRANTOR to restore the subsurface and surface of the easement herein granted and conveyed, to a like condition existing prior to the grant of this easement and to indemnify and save and hold harmless GRANTOR from any and all losses, claims, actions or judgments for damages or injuries to persons or property arising out of or from, or caused by, the construction, operating, maintenance and use of the aforesaid easement.
