SCS Brighton LLC, is pleased to submit the enclosed Certificate of Zoning Compliance, and
Design Review applications for the proposed multi -family apartments, clubhouse, and parking
structures on the 8.16 -acre property north of I-84 Boulevard and east of Meridian Rd (below).
The objective of the proposed actions is to enable the development of a 240 unit; 144 one bedroom
units and 96 two bedroom units multifamily apartment building, clubhouse, and parking structures
(see Conceptual Site Plena, page 2), the details of that proposal follows.

The subject property is located in the area governed by the Ten Mile Interchange Specific Area Plan
(TMISAP). The TMISAP focuses on developing an area that has an identity of its own but which links to
nearby developments. The plan emphasizes the community's support for higher densities and mixed uses to
create a vibrant and economically strong city. The plan also stresses the community's commitment to good
site planning and design as a means of establishing a place everyone can be proud of and one that protects
the interests of future businesses and residents
The Future Land Use Map (FLUM) contained in the TMISAP designates the subject property with the
following land use types: Mixed Use - Commercial (MU -C) and Lifestyle Center (LC).
MU -C designated areas are intended for the development of multi -family or single-family attached
residential uses. The proposed multi family residential development will contribute to the variety o housing
types available within this part of the City and will offer rental options for 1- and 2 -bedroom units. This MU -
C designation requires developments to integrate the three major use categories: residential, commercial, and
employment. This site satisfies this designation since it is located adjacent to future employment and
shopping within the TM Creek development as well as the Ten Mile Center and TM Crossing projects to the
south consist of traditional neighborhood design concepts with a strong pedestrian -oriented focus are
essential.
The LC designation is a specific form of Mixed Use Commercial. LC designated areas encourage a diversity
of compatible land uses in a unified development that includes a mix of retail, professional services, offices,
entertainment uses, civic services, housing and public outdoor spaces. The design of the proposed
arrangement of buildings is oriented to pedestrians. The proposed development lies next to the Ten Mile
Creek open space corridor which will contain a pathway that will promote neighborhood connectivity.
Streetscape improvements are provided that create rich and enjoyable public spaces. Structured parking is
provided. Community gathering places are provided which include clubhouse, pool, and public lounge areas
to create a sense of place.
We are proposing to develop the site with two structures containing a total of 240 dwelling units as allowed
in MU -C and LC designated areas.
IN CONCLUSION
Based on the foregoing and as supported by the accompanying applications and documentation, we request
approval of (1) Certificate of Zoning Compliance; and (2) Design Review Approval of the proposed unit
elevations and floor plans.

Narrative Letter - Development Code Compliance
The proposed multi -family project known as Ten Mile Creek Apartments consists
of 240 dwelling units, a clubhouse, pool -house, pool, spa, detached garages and covered
parking stalls. The project has been favorably received by the Planning Commission and
other city entities.
The proposed architectural character for the Ten Mile Creek Apartments is based
on a modern, resort aesthetic. The overall layout of the site directs attention toward the
common amenities, including a spacious clubhouse, pool area and green space, which are
centrally located. A number of dwelling units face Ten Mile Creek, which will be
developed into an attractive pedestrian walkway amenity.
The clubhouse and adjacent pool area will provide the feel of a resort. The
pivoting, glass entry door will lead into a spacious lobby and reception/leasing offices.
The great room with kitchen will provide a large space for gathering and socializing. The
great room opens to large patios that will extend the social opportunities outside. The
fitness/TRX/Crossfit portion of the clubhouse is larger than typical and will be an
attractive amenity to the residents. The exterior of the clubhouse is designed to feel like a
high-end, modern residence or golf -clubhouse. The materials are glass, stone veneer, lap
siding and stucco with large roof overhangs and multiple sloped roofs. There are trellises,
planters and patios. The materials and colors are sympathetic and cohesive with the
design of the apartment and garage buildings. The pool and pool -deck area provides more
than enough room for swimming, lounge chairs, sun bathing, covered decks and
relaxation. The pool -house also contains space for secured bicycle storage.
The apartment building matches style, materials and colors with the clubhouse
and garage buildings. The open concept interiors focus on large windows and decks. The
interior corridors provide minimal building entrances and allow for high security and
safety.
The detached garage buildings are small in scale and match the other buildings on
site regarding style, color, form and materials.
The apartment buildings are larger than the other buildings. To deal with this
mass, the units have been divided into two buildings. They are separated by green and
common space. The parking areas are also broken into smaller areas and buffered with
landscaping. The 1 -story garage buildings are located on the perimeter of the property to

help transition the scale up to the larger apartment buildings and provide a buffer from
public to private.
The building forms are broken up and divided through the use of jogs, protruding
balconies, and individual unit size variations.
The apartment buildings implement the use of protruding balconies as a means of
emphasizing them as architectural features. The use of materials and variations of stucco
color help to differentiate the architectural features.
Consistent exterior building materials are used in order to create a cohesive
design. These materials include brick, cast stone, stucco, glass and siding.
The signage is clean, simple and modern. A monument sign is located at the
Southwest corner of the property. The two apartment buildings each have a sign on their
facades, the West building has a sign on its south facade near the entrance and stair tower
and the east building has a sign on its east facade near the entrance.
Site lighting is achieved through the use of slim, modern poles with matching
LED fixtures.
The parking lots have been broken into smaller pods. The pods are then
surrounded by landscaping and further subdivided by landscape islands and peninsulas.
Pedestrian routes are provided throughout the property and interconnect the
buildings and amenities. They also connect the property to public ways and the adjacent
Ten Mile Creek trail.

SCS Brighton, LLC, has thoughtfully considered the overall design of the Ten Mile Creek Apartments in
context of the overall Ten Mile development. We have designed a modern project that will be additive
to the future build out of Ten Mile. We are requesting design exceptions on the following standards:
Standard R3.40: Modulate and articulate roof forms to create building profile interest and to
reduce the appearance of building mass and scale. Applies to public oriented
facades visible from a public street, public spaces, and pedestrian
environments.
Response: The buildings are jogged to create modulated and articulated roof forms. The
building forms have intentionally different colors to break up the massing and
provide interest. Additionally, these modulations will enhance the appearance
and building profile as seen from public spaces and pedestrian environments.

Standard R3.30: Design accessory structures to be compatible with residential buildings.
Accessory structures include, but are not limited to, sheltered mailboxes,
storage areas, maintenance and recreation facilities, detached garages and
carports, and secondary dwellings.
Response: The accessory structures have been designed to complement the main
apartment building, not be miniature copies. They use modern lines, similar
colors, and clean materials. The lines and massing of the accessory buildings
relate to and enhance the lines and massing of the main apartment buildings.
Standard TMISAP: The elevations do not comply with the base, body and top design guidelines in
the TMISAP below (i.e. all of the stories incorporate the same design
elements/colors, there is nothing that differentiates each story). The architect
should address why the proposed elevations should be exempt.
Response: The proposed design does meet and exceeds the intent of the TMISAP. The
base of the building is defined by brick veneer. Each floor is delineated by
cantilevered decks with railings. The top of the building has clean, modern lines.
