Broadway Street Meridian, ID 83642 RE: Thair Pond Existing Shop Variance Submittal for Location in front of Existing Home Dear Honorable Mayor and City Council Members, On behalf of Thair Pond, this letter is to accompany the Variance submittal for the existing shop location (accessory structure) partially in front of the existing home within the future Pond Subdivision. This 0.91 acre parcel is part of a 4.85 acre final plat application for the overall Pond Subdivision that was submitted recently. The Preliminary Plat application (H-2017-0115) for the subdivision was approved on November 8, 2017 by the City Council. At that time, the request for a "waiver" for this issue was determined to not be the appropriate procedure by staff and a variance application was required. This property was approved for annexation into the City of Meridian on January 22, 2013 with the Tomorrow's Hope application (AZ 12-014 and CUP 12-020) with an R-8 zoning and a development agreement (Inst. #1130019366). The existing shop is currently 258 feet east of Meridian Road and will be 118 feet east of the new E Addeson Street upon Pond Subdivision completion/recordation in 2018. The shop is approximately 49 feet wide and split 28 feet west of the front of the house and 21 feet east of the front of the house. The incorporation of the house and shop "complex" originally approved on a large, 5 - acre parcel in the County into a large 0.91 acre lot in the City of Meridian presents a unique circumstance requiring the variance to keep the existing shop located partially in front of the existing residence. The shop is located far from the public road at the end of a long driveway (118 feet) and will be screened by fencing and landscaping to be constructed by the Pond Subdivision (see attached exhibit). Granting of the variance will relieve an undue hardship due to the unique characteristics of the site and existing structure locations. The requested variance shall not grant a right or special privilege that is not otherwise allowed in the district. In addition, the requested variance will not be detrimental to the public health, welfare, or safety.
