AGREEMENT AND GRANT OF EASEMENT
This agreement, made thi~1ay of September, 1997, between RICHARD W,
HOYLE, dba Knotty Pine Motel, located at 1423 East First Street, of the City of Meridian,
County of Ada, State ofIdaho, parties of the first part, which expression shall include his, her or
their heirs, executors, administrators, agents or assigns where the contest so requires or admits,
and RICHARD W. HOYLE, a single man, owner of property at 1409 East First Street, of the
City of Meridian, County of Ada, State ofIdaho, party of the second part, which expression shall
include his heirs, executors, administrators, agents or assigns, where the context so requires or
admits, witnesseth:
WHEREAS,. the parties of the first part own and have title to the real estate located in the
County of Ada, State ofIdaho, and described as follows:
A part of Blocks 4 and 5 ofF. A. Nourse's Third Addition to Meridian, according to the plat
thereof filed in Book 6 of Plats at Page 289, records of Ada County, Idaho, more particularly
described as follows:
Beginning at the Northeast corner of said Block 4; thence
North along the East boundary of said Block 5 a distance of 4 feet to a
point; thence
West, parallel to the South boundary of said Block 5 a distance of 224
feet to a point; thence
South parallel to the East boundary of said Block 5, a distance of 4 feet
to a point on the South boundary of said Block 5; thence
West along the North boundary of said Block 4 a distance of73 feet, more
or less, to the Northeast corner of that parcel ofland described
in Warranty Deed No, 379366; thence
South parallel to the West boundary of said Block 4 a distance ofl86
feet, more or less, to the Northwest corner of that parcel ofland
described in Warranty Deed No. 554947; thence
East parallel to the North boundary of said Block 4 a distance of73,6
feet, more or less to the Northeast corner of that parcel ofland
described in Wan-anty Deed No. 554947; thence
South a distance of33 feet, more or less, to the Southwest corner of
that parcel ofland described in Warranty Deed No. 567137; thence
East parallel to the North boundary of said Block 4 a distance of 90 feet
to the Southeast corner of that parcel ofland described in Warranty
Deed No. 567137; thence
North parallel to the East boundary of said Block 4, a distance of 70
feet to the Northeast corner of that parcel ofland described in
Warranty Deed No. 567137; thence
East parallel to the North boundary of said Block 4, a distance of 143.3
feet to a point on the East boundary of said Block 4; thence
North along the East boundary of said Block 4, a distance of 145 feet to

WHEREAS, the party of the second part own and have title to the real estate located in
the County of Ada, State ofIdaho, and described as follows:
A part of Block 4 of Amended Plat ofF.A. Nourse's Third Addition to
Meridian, according to the Official Plat thereof filed in Book 6 of Plats at
page 289, records of Ada County, Idaho, described as follows:
BEGINNING at the Northeast corner of said Block 4; thence
South along the East line of said Block, 145 feet to the
POINT OF BEGINNING, thence continuing
South along said line 70 feet to a point; thence at right
angles
West 143.3 feet to a point; thence
North parallel to the East line of said Block, 70 feet to
a point; thence at right angles
East 143.3 feet to the POINT OF BEGINNING.
WHEREAS, The party of the Second part desires to build a parking lot and
stormwater drainage facility on his property above stated and on the property of
the party ofthe first part; and
WHEREAS, The party of the First part, GRANTOR, has agreed, in
consideration of$IO.OO, and other good and valuable consideration, to grant the
party of the Second part, GRANTEE, an easement or right of way over said
property of the party of the First part; and
WITNESSETH, That in pursuance of said agreement and in consideration
of the sum of$1O.00 paid by the Grantee to the Grantor, the receipt whereof is
hereby acknowledged, the Grantor hereby grants to the Grantee, his heirs and
assigns:
Full and ftee right and liberty for him and them, his and their tenants,
servants, visitors, and licensees, in common with aU others having the like right, at
all times hereafter, with or without vehicles of any description, for all purposes
connected with the use and enjoyment of said land of the Grantee, to construct,
facilitate and use, permanently, a parking lot and stormwater drainage facility, and
to pass and repass along said land.
To have and to hold the easement or right of way hereby granted unto the
Grantee, his heirs and assigns, as appurtenant to the said land of the Grantee,
