DESCRIPTION OF APPLICANT'S REQUEST
The applicant request Certificate of Zoning Compliance (CZC) approval to convert an existing
vacant tenant space (Suite A) to a daycare center and occupy suite E as a learning center for a
maximum of 73 children on the site. The proposed site improvements include adding an
outdoor play area and additional landscaping on the east and south side of the building.
The property is 0.94 acres in the Limited Office Zoning district (L -O). The daycare center use
is a principally permitted use in the L -O zone, subject to the specific use standards set forth in
UDC 11-4-3-9.
The site is located at 1552 N. Crestmont Drive.
DECISION
The applicant's request for Certificate of Zoning Compliance is tentatively approved
with the conditions listed in this report. Approval shall be finalized upon completion of
specific use requirements in Unified Development Code 11-4-3-9.
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to

must complete that process before you commence the use or construction. Please contact
Building Servicesfor additional details about building permits and inspections.
Site Conditions of Approval
1. Prior to certificate of occupancy, proof of background check and fire inspection
shall be provided to the Planning Division. The applicant or owner shall comply
with all State of Idaho and Department of Health and Welfare requirements for
daycare facilities.
2. All outdoor play areas shall be completely enclosed by minimum six foot (6) non -
scalable fences to secure against exit/entry by small children and to screen abutting
properties.
3. Business hours of operation within the L -O districts shall be limited from 6 am to 10
pm as set forth in UDC 11 -2B -3A4. The applicant is proposing to operate between
the hours of 6am and 6pm consistent with this standard.
4. The applicant shall construct a 20 -foot wide landscape buffer along a portion of
the east and south boundary in accord with UDC Table 11-213-3. The landscape
buffer shall comply with the landscape requirements set forth in UDC 11-313-9C.
The existing vegetation along these boundaries must be protected during the

construction of the outdoor play area.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the
property, the applicant shall submit a sign permit application consistent with the
standards in UDC Chapter 3 Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health
as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other
improvements in accord with UDC 11 -5C -3C.
3. The site plan prepared by ALC Collaborative, dated November 1, 2017, labeled Site
Plan, is approved by the City of Meridian Planning Division as shown in Exhibit B,
with the following comments:
a. The existing parking stalls and drive aisles shall comply with the
dimensions set forth in UDC Table 11-3C-5.
b. Add a bike rack near the main entrance of the facility in accord with UDC
11 -3C -5C and 11 -3C -6G.
4. The approved site/landscape plan may not be altered without prior written approval of
the City of Meridian Planning Division.
5. The applicant shall pay any applicable impact fees prior to the issuance of a building
permit.
6. If any changes must be made to the site plan to accommodate ACRD requirements, the
applicant shall submit a new site plan to the City of Meridian Planning Division for
approval prior to issuance of the building permit.
7. The applicant shall complete all required improvements prior to issuance of a
Certificate of Occupancy. It is unlawful to use or occupy any building or structure until
the Building Official has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation
that meets the standards as set forth in UDC 11-313-6 and to install and maintain all
landscaping as set forth in UDC 11-3B-5, UDC 11-313-13 and UDC 11-313-14.
2. The applicant shall comply with the outdoor storage as an accessory use standards as
set forth in UDC 11-3A-14.
3. The project is subject to all current City of Meridian ordinances and previous
conditions of approval associated with this site (Midtown Square No. 2 PFP 1998).
4. The issuance of this CZC does not release the applicant from any previous
requirements of the other permits issued for the site.
5. The applicant and/or property owner shall have an ongoing obligation to prune all trees
to a minimum height of six feet above the ground or sidewalk surface to afford greater
visibility of the area.
6. The applicant has a continuing obligation to comply with the outdoor lighting
provisions as set forth in UDC 11-3A-11.
7. The applicant and/or property owner shall have an ongoing obligation to maintain all
landscaping and constructed features within the clear vision triangle consistent with the
standards in UDC 11-3A-3.
8. The applicant and/or assigns shall have the continuing obligation to meet the specific
use standards for the proposed use as set forth in UDC 11-4-3-9 Daycare Facility. The
operator of the facility shall ensure that parents park in designated parking stalls

to ensure safe discharge and pick up of children.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division on or
before November 28, 2017, within fifteen (15) days after the written decision is issued, and
contain the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
EXPIRATION
The Certificate of Zoning Compliance shall expire if the construction, alteration or the use has
not commenced within one year of the date of issuance of the Certificate of Zoning
Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid
until November 13, 2018.

Re: Certificate of Zoning Compliance - Narrative
To whom it may concern :
We are proposing a Daycare Tenant Improvement within an existing building and partially within
an existing tenant suite. There is a portion of the proposed Daycare Tenant Improvement that
will encompass a portion of the existing building that has not been occupied, this space is
described in the attached exhibits as Suite 'A'. Adjacent tenants are compatible with typical office
space / use. Adjacent properties are solely single-family residential.
The licensed daycare intends to accommodate 25 pre-school age children. The existing learning
center (non -licensed) will accommodate another 48 children and adults. Within the facility there
will be approximately 73 children and adults at maximum capacity.
The main entrance to the Daycare will be along the West side of the existing Building, which is
located very near (9) existing parking spaces, that can be utilized as the child drop-off zone.
Adjacent tenants do not currently utilize the West side entrances of the existing building and
therefore this area would be purposed solely for the Daycare use entrance.
As part of the Daycare use, it is desired to have an outdoor play yard. This play yard would be
located at the East end of the building in area of the site that is currently utilized as parking. The
portion of the property where the play yard will be located is adjacent to residential uses and
therefore requires a 20'-0" landscape buffer. A landscape buffer is shown on the updated site
plan. Currently, a 6'-0" tall non -scalable fence exists along the Southern and Eastern property
lines. In order to maintain delineation of the landscape buffer between the play yard and the
residential properties we propose a shorter (4'-0" tall) interior chain-link fence. This chain-link
would allow visual of the 20'-0" landscape buffer. The play yard would be accessible from with
the proposed tenant suite and we would provide a new 6'-0" tall visually solid fence with gate to
the existing exterior sidewalk. A detail of the chain-link and solid fence are provided for
reference.
We plan to provide a more suitable play surface, by removing the existing asphalt or by covering
the existing asphalt, surfacing at this time is undetermined, however we are planning to provide
a rubberized mulch to soften the surface of the asphalt. Within the play yard the tenant does not
intend to have play equipment that is taller than 6'-0" in height and therefore play equipment is
not indicated on the proposed site plan.
