The Idaho Transportation Department (ITD) has reviewed the city council review application by Justin
Hadley on behalf of AT&T requesting a City Council Review of the Planning and Zoning Commission’s
denial of a wireless communications facility on a parcel located at 1776 North Avest Lane east of North
Locust Grove Road and north of East Fairview Avenue, west of SH-55 milepost 38.10. ITD has the
following comments:
1. This property does not abut the State Highway system.
2. IDAPA 39.03.60 governs advertising along the State Highway system. The applicant may contact
Justin Pond, Program Manager for ITD’s Headquarters Right-of-Way Section at 334-8832 for
more information.
3. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State Highway.
4. ITD does not object to the city council review application as presented.
