Re: Swindell Subdivision — Development Agreement Modification

Dear Madam Mayor and Members of the City Council:
The Swindell Subdivision is an eight lot development at the north-west quadrant of Locust
Grove and Overland with seven lots Zoned CC and one previously developed lot Zoned CG. The
utilities have been installed, the roadway constructed and the final plat will be recorded within
the next two weeks.
The property owner, Volante Investments LLLP and the City of Meridian entered into a
Development Agreement dated May 24, 2016 which was recorded May 25, 2016. A condition of
approval required that the Development Agreement be modified to include a conceptual site
plan for the development and a sampling of building elevations to reflect the type of buildings
to be constructed on the lots. This Development Agreement Modification application is the
satisfaction of that requirement.
With the completion of the roadway, there are parties interested in purchasing and building on
the lots. These interested parties include several office uses and a family entertainment use on
the freeway. Included is a conceptual site plan, a rendering of one of the office uses and a
sketch of the family entertainment use. We have also included photographs of other buildings
which are representative of other buildings which could be built on the lots.
We ask that you approve this Development Agreement Modification so we can commence with
the sale and development of these lots.

We are the owners of the property in the northwest quadrant of the intersection of Locust Grove Road
and Overland Road. The City of Meridian is requiring that we modify the Development Agreement with
the addition of a conceptual site plan and photos of conceptual elevations. The City of Meridian requires
that prior to application that we hold an informational meeting to answer any questions from the
neighbors.
The neighborhood meeting will be held at our offices, the address is listed above, on Monday, October
16th at 4:30-5:30pm. Please feel free to come by between those hours or feel free to call Brad Miller -
887 -7994 with any questions.
COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
