Black Cat Road (IV. B. Owner) • An ACHD staff report was transmitted to the City on August 31, 2017. I’ve attached a copy of the report. Please revise IX. A.2. Access in the staff report. • The extension of the 14 foot pathway along Black Cat Road is not needed, as we are already constructing a 5’ wide sidewalk on Black Cat Road along the length of the property, per ACHD requirements. ACHD requires concrete sidewalks/paths in the right-of-way, not the asphalt multiuse pathway that is proposed along Five Mile Creek. Pedestrians will use the sidewalk. Bicyclists will travel Black Cat Road either north or south (there is currently no destination directly to the east). Moving bicyclists to an un-signalized intersection will create even more vehicle/bike conflicts. When the property east/across Black Cat Road develops, then bikers will cross over Black Cat Road where the current pathway ends and will follow a future pathway along Five Mile Creek. Also, when that path along Five Mile Creek east of Black Cat is constructed in the future, it is highly unlikely that bicyclists will take a unnecessary detour to the north, then cross and then travel south to continue along the Five Mile Creek path. We request that condition 1.1.2 be deleted. • In IX. A. 2. Building Elevations (Page 7) a reference is made to a certificate of zoning compliance and design review for changing rooms and a swimming pool. Please delete that paragraph from the staff report. • Condition 2.1.4 needs to be clarified. The “wet signature” is not in the pond, but is a wet area southwest of the pond caused by a seep. This condition may also need to be further clarified to note that we will follow the direction of the Corps of Engineers and will comply with their requirements.
